(2) The Minister shall compute the compensation for a power development on the basis of the figure previously fixed in accordance with section 19 as the actual cost of the development, adjust this figure so as to make allowance for any variation in the purchasing power of the dollar as shown by the official trade index or other official statistics most applicable to the case, and deduct an amount equivalent to the actual loss in value of the works due to their physical or functional depreciation or to other causes.
(2) L’indemnité pour ledit aménagement de force motrice est déterminée par le ministre en prenant comme base le chiffre antérieurement fixé en application de l’article 19 comme étant le coût réel de l’aménagement, puis en pratiquant un rajustement de ce chiffre afin qu’il soit tenu compte de toute variation dans le pouvoir d’achat du dollar, révélée par l’indice officiel du commerce, ou autre statistique officielle, le plus susceptible d’application au cas en question, et enfin en déduisant une somme équivalente à la diminution de la valeur de l’entreprise attribuable à sa dépréciation physique ou fonctionnelle ou à d’autres causes.

(5) The total annual outlay in respect of works undertaken under this section shall be a charge upon such of the water-power developments on the stream as are in a position to utilize the regulated or increased flow in whole or in part, and shall be apportioned among them in proportion to the respective benefits estimated as accruing from time to time to those developments from the regulated or increased flow.
(5) Les frais annuels, à l’égard des ouvrages entrepris en application du présent article, constituent une charge sur les aménagements de forces hydrauliques du cours d’eau qui sont en état d’utiliser, en totalité ou en partie, le débit ainsi régularisé ou accru, et sont répartis parmi ces aménagements dans la proportion des avantages estimatifs respectifs retirés, de temps en temps, par ces aménagements, du débit ainsi régularisé ou accru.

8 (1) Approval for the abandonment of the operations of any branch line within the meaning of section 252 of the Act may be given by the Commission under section 106 of the Act if the abandonment of such branch line results from flooding for a hydro-electric power development or if the branch line is made or is to be made otherwise unusable by a lawful act of a duly constituted authority.
8 (1) L’approbation de l’abandon de l’exploitation d’un embranchement au sens que donne à ce mot l’article 252 de la Loi pourra être donnée par la Commission en vertu de l’article 106 de la Loi si l’abandon de cet embranchement résulte de la submersion dudit embranchement pour l’aménagement d’une centrale hydro-électrique ou si ledit embranchement est ou doit être rendu inutilisable d’autre façon par un acte légitime d’une autorité régulièrement constituée.

(d) the Minister, upon giving the licensee one year’s notice, may at any time cancel a licence granted under this section, and resume full possession and control of the water-power development and of all works, lands and structures connected therewith or, at the option of the Minister, of such part of the works and structures as are situated upon public lands; and

Therefore, in order to take account of technical progress and developments in relevant international standards, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of the following: amending Sections C and D of Annex I to Directive 2000/36/EC; amending Part B of the Annex to Directive 2001/111/EC; and amending Annex II and Part B of Annex III to Directive 2001/113/EC.

Therefore, in order to ensure the consistent implementation of Directives 2000/36/EC and 2001/111/EC, additional powers to amend Sections C and D of Annex I to Directive 2000/36/EC and Part B of the Annex to Directive 2001/111/EC should be delegated to the Commission to take account of developments in relevant international standards.
