IN-CONTEXT TRANSLATIONS

This Directive respects the principles recognised by Article 2 TEU, respects fundamental rights and freedoms and observes the principles recognised, in particular, by the Charter, including those set out in Titles II, III, V and VI thereof which encompass, inter alia, the right to liberty and security, freedom of expression and information, freedom of association and freedom of thought, conscience and religion, the general prohibition of discrimination, in particular on grounds of race, colour, ethnic or social origin, genetic features, language, religion or belief, political or any other opinion, the right to respect for private and family life and the right to protection of personal data, the principles of legality and proportionality of criminal offences and penalties, covering also the requirement of precision, clarity and foreseeability in criminal law, the presumption of innocence as well as freedom of movement as set out in Article 21(1) of the Treaty on the Functioning of the European Union (TFEU) and in Directive 2004/38/EC of the European Parliament and of the Council .

(1) The purpose of this Directive is to enhance the right to a fair trial in criminal proceedings by laying down minimum rules concerning certain aspects of the presumption of innocence and the right to be present at the trial and to ensure that suspects and accused persons in criminal proceedings in the Member States receive a common and high level of protection with full respect for procedural guarantees throughout the Union, without prejudice to the higher protection standards which may be in use in a given Member State.
(1) La présente directive a pour objet de renforcer le droit à un procès équitable dans le cadre des procédures pénales, en définissant des règles minimales concernant certains aspects de la présomption d'innocence et le droit d'assister à son procès, et de garantir que les suspects et les personnes poursuivies dans des procédures pénales dans les États membres bénéficient, dans l'ensemble de l'Union, d'un niveau commun élevé de protection dans le respect plein et entier des garanties procédurales, sans préjudice des normes de protection plus élevées pouvant être utilisés dans un État membre donné.

(26) This Directive respects fundamental rights and observes the principles recognised in particular by the Charter of Fundamental Rights of the European Union and notably the right to liberty and security, the respect for private and family life, the freedom to choose an occupation and right to engage in work, the freedom to conduct a business, the right to property, the right to an effective remedy and to a fair trial, the presumption of innocence and the right to defence, the principles of the legality and proportionality of criminal offences and penalties, as well as the prohibition of being tried or punished twice in criminal proceedings for the same criminal offence.

Furthermore, those provisions should not prevent Member States from providing for a rebuttable presumption of the authorisation of exploitation in respect of the exclusive rights of performers provided for in the relevant provisions of this Directive, in so far as such presumption is compatible with the International Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organisations (hereinafter referred to as the Rome Convention).

Points out that the presumption of innocence enjoyed by every suspect and everyone being prosecuted must be respected at each stage of the procedure up until the time when a final guilty verdict is given by a court; notes with interest the draft law drawn up by the French Government with the aim of strengthening the presumption of innocence;

Condemns murders, kidnappings, extortion of money and acts of violence and physical and psychological torture perpetrated by terrorist organisations; believes nonetheless that no political reasons or claims can justify terrorist acts, and that terrorism must be resolutely combated; urges the Member States to continue to collaborate closely in the fight against terrorism by stepping up cooperation between European Courts and police forces; believes that any response to violations of human rights must, however resolute, go hand-in-hand with scrupulous respect for the standards required by the rule of law and that, in particular, the presumption of innocence, the right to a fair trial and the rights of defendants must be guaranteed;
