IN-CONTEXT TRANSLATIONS

The application of the pro forma financial information building block set out in Annex II to Regulation (EC) No 809/2004 is conditional upon a significant gross change in the size of the issuer, therefore the words ‘(if applicable)’ should be added to the heading of the column entitled ‘BUILDING BLOCK’ applicable to the registration document in Annex XVIII to that Regulation to reflect the conditional applicability of Annex II to that Regulation.

If a pro forma registration is required by a Member State, the Member State concerned shall ensure that, by . at the latest, pro forma registration with the point of single contact is available by electronic means and does not delay or in any way complicate the provision of the services in question and does not entail any additional expense for the provider.

This pro forma registration, which should not, however, pose additional administrative and obstacles for migrants (fast track), would ensure that the provider of the cross-border services is subject to the same rights and obligations as the nationals of the host Member State, in particular to its rules of conduct.

(7) For the free provision of services, where the service provider moves to the territory of another Member State, provision should be made to enable the Member States to introduce a system for notification and pro forma registration with the professional association or similar body that would be competent in the territory if the professional were exercising the freedom of establishment, together with a requirement for temporary registration with the social security body of the host Member State, with the right to transfer contributions that have been made to the social security body of the Member State of establishment.

For health professions, where public safety concerns are particularly important, those obligations would include advance declarations to host Member State authorities and, in some cases, pro forma registration.

For this purpose and in addition to the declaration referred to in paragraph 2 relating to the provision of services, Member States may, so as to permit the implementation of the provisions relating to professional conduct in force in their territory, require automatic temporary registration or pro forma registration with a professional organization or body or in a register, provided that this registration does not delay or in any way complicate the provision of services or impose any additional costs on the person providing the services.
À cette fin et en complément de la déclaration relative à la présentation de services visée au paragraphe 2, les États membres peuvent, en vue de permettre l'application des dispositions disciplinaires en vigueur sur leur territoire, prévoir une inscription temporaire intervenant automatiquement ou une adhésion pro forma à une organisation ou à un organisme professionnel ou une inscription sur un registre, à condition que cette inscription ne retarde ni ne complique en aucune manière la prestation de services et n'entraîne pas de frais supplémentaires pour le prestataire de services.
