IN-CONTEXT TRANSLATIONS

In order to ensure uniform conditions for the implementation of this Regulation implementing powers should be conferred on the Commission with respect to: listing the plants, plant products and other objects which are prohibited from being introduced into the Union territory, and the third countries concerned; listing the plants, plant products and other objects subject to special requirements, and the special requirements concerned for their introduction into, and movement within, the Union territory; the provisional listing of the high-risk plants, plant products and other objects whose introduction into the Union territory is to be prohibited, and the third countries concerned; the procedure for risk assessment in connection with that listing; setting out, for third countries, requirements that are equivalent to the requirements for movement within the Union territory of plants, plant products or other objects; setting out arrangements for the presentation and use of posters and brochures concerning the introduction of plants, plant products and other objects into the Union territory; setting out specific conditions or measures concerning the introduction of particular plants, plant products and other objects into frontier zones of Member States; adoption of temporary measures concerning plants, plants products and other objects likely to pose newly identified pest risks or other suspected phytosanitary risks; adopting decisions on temporary measures taken by Member States concerning imminent danger; listing of plants, plant products and other objects which are prohibited from being introduced into certain protected zones; listing the plants, plant products and other objects subject to special requirements, and the special requirements concerned for their introduction into, and movement within, certain protected zones; and laying down rules concerning the requirements for quarantine stations and confinement facilities, and the release of plants, plant ...

(69) In order to ensure fair competition among operators, the traceability of the imported products intended to be placed on the market within the Union as organic or the transparency of the recognition and supervision procedure for control authorities and control bodies within the context of import of compliant organic products, and in order to ensure the management of the list of third countries recognised for the purpose of equivalence under Regulation (EC) No 834/2007, the power to adopt certain acts should be delegated to the Commission in respect of the documents intended for customs authorities in third countries, in particular an organic export certificate, in electronic form wherever possible, the documents necessary for the purposes of import, also in electronic form wherever possible, the criteria for recognition or withdrawal of the recognition of control authorities and control bodies in the context of import of compliant organic products, and in respect of the information to be sent by third countries recognised under that Regulation necessary for the supervision of their recognition and the exercise of that supervision by the Commission, including on-the-spot examination.
(69) Afin de garantir une concurrence équitable entre les opérateurs, la traçabilité des produits importés destinés à être mis sur le marché de l'Union en tant que produits biologiques, ou la transparence de la procédure de reconnaissance et de supervision des autorités et des organismes de contrôle dans le contexte de l'importation de produits biologiques conformes, et afin d'assurer la gestion de la liste des pays tiers reconnus aux fins de l'équivalence en vertu du règlement (CE) n° 834/2007, il convient de déléguer à la Commission le pouvoir d'adopter certains actes en ce qui concerne les documents destinés aux autorités douanières des pays tiers, notamment un certificat d'exportation biologique, sous forme électronique si possible, les documents nécessaires aux fins de l'importation, également sous forme électrique si possible, les critères de reconnaissance ou de retrait de la reconnaissance des autorités et organismes de contrôle dans le contexte de l'importation de produits biologiques conformes, et en ce qui concerne les informations que les pays tiers reconnus en vertu de ce règlement doivent soumettre car elles sont nécessaires aux fins de la supervision de leur reconnaissance et de l'exercice de cette supervision par la Commission, y compris au moyen d'examens sur place.

In order to ensure uniform conditions for the implementation of this Regulation implementing powers should be conferred on the Commission with respect to: listing of the plants, plant products and other objects, and the respective third countries of origin or dispatch, for which a phytosanitary certificate is to be required for their introduction into the Union territory; listing of the plants, plant products and other objects, and the respective third countries of origin or dispatch, for which a phytosanitary certificate is to be required for their introduction into certain protected zones from those third countries; listing of the plants, plant products and other objects, the third countries concerned, and the maximum quantity subject to be exempted from the requirement for a phytosanitary certificate when introduced in the Union territory; and setting out technical arrangements concerning the invalidation of the electronic phytosanitary certificates.

In order to avoid further difficulties and to clarify the link between Commission Regulation (EC) No 1235/2008 of 8 December 2008 laying down detailed rules for implementation of Council Regulation (EC) No 834/2007 as regards the arrangements for imports of organic products from third countries (2) and Commission Regulation (EC) No 889/2008 of 5 September 2008 laying down detailed rules for the implementation of Council Regulation (EC) No 834/2007 on organic production and labelling of organic products with regard to organic production, labelling and control (3), it is necessary to recall the duties of the control authorities or control bodies of Member States as regards non-compliant products imported from third countries recognised in accordance with Article 33(2) of Regulation (EC) No 834/2007 or from third countries having control authorities or control bodies recognised in accordance with Article 33(3) of that Regulation.
Afin d’éviter d’autres difficultés et de clarifier le lien entre le règlement (CE) no 1235/2008 de la Commission du 8 décembre 2008 portant modalités d’application du règlement (CE) no 834/2007 du Conseil en ce qui concerne le régime d’importation de produits biologiques en provenance des pays tiers (2) et le règlement (CE) no 889/2008 de la Commission du 5 septembre 2008 portant modalités d’application du règlement (CE) no 834/2007 du Conseil relatif à la production biologique et à l’étiquetage des produits biologiques en ce qui concerne la production biologique, l’étiquetage et les contrôles (3), il est nécessaire de rappeler les tâches des autorités ou organismes de contrôle des États membres en ce qui concerne les produits non conformes importés des pays tiers reconnus conformément à l’article 33, paragraphe 2, du règlement (CE) no 834/2007 ou des pays tiers disposant d’autorités ou organismes de contrôle reconnus conformément à l’article 33, paragraphe 3, dudit règlement.

4. To the extent permitted by the Protocol, the Commission may, in agreement with both the competent authority of the Member State in which a producer’s relevant production is situated and the government of the third country Party concerned, authorise a producer to combine the calculated levels of production laid down in Article 10 and Article 11(2) with the calculated levels of production allowed to a producer in a third country Party under the Protocol and that producer’s national legislation for the purpose of industrial rationalisation with a third country Party, provided that the combined calculated levels of production by the two producers do not exceed the sum of the calculated levels of production allowed to the Community producer under Article 10 and Article 11(2) and the calculated levels of production allowed to the third country Party producer under the Protocol and any relevant national legislation.
4. Dans la mesure où le protocole le permet, un producteur peut, pour des motifs de rationalisation industrielle avec un pays tiers partie au protocole, être autorisé par la Commission, en accord avec l’autorité compétente de l’État membre dans lequel se situe sa production concernée et avec le gouvernement du pays tiers concerné, à associer ses niveaux calculés de production fixés à l’article 10 et à l’article 11, paragraphe 2, avec les niveaux calculés de production autorisés pour un producteur d’un pays tiers en vertu du protocole et de la législation nationale dudit producteur, pour autant que la somme des niveaux calculés de production des deux producteurs ne dépasse pas la somme des niveaux calculés de production autorisés conformément à l’article 10 et à l’article 11, paragraphe 2, pour le producteur communautaire et des niveaux calculés de production autorisés pour le producteur du pays tiers en vertu du protocole et de la législation nationale applicable.

10. To the extent permitted by the Protocol, the Commission may, in agreement with both the competent authority of the Member State in which a producer's relevant production is situated and the government of the third Party concerned, authorise a producer to combine the calculated levels of production laid down in paragraphs 1 to 9 with the calculated levels of production allowed to a producer in a third Party under the Protocol and that producer's national legislation for the purpose of industrial rationalisation with a third Party, provided that the combined calculated levels of production by the two producers do not exceed the sum of the calculated levels of production allowed to the Community producer under paragraphs 1 to 9 and the calculated levels of production allowed to the third Party producer under the Protocol and any relevant national legislation.
10. Dans la mesure où le protocole le permet, un producteur peut, pour des motifs de rationalisation industrielle avec un pays tiers au sein du protocole, être autorisé par la Commission, en accord avec l'autorité compétente de l'État membre dans lequel se situe la production concernée et avec le gouvernement du pays tiers concerné, à associer ses niveaux calculés de production fixés aux paragraphes 1 à 9 avec les niveaux calculés de production autorisés pour un producteur d'un pays tiers en vertu du protocole et de la législation nationale dudit producteur, pour autant que la somme des niveaux calculés de production des deux producteurs ne dépasse pas la somme des niveaux calculés de production autorisés conformément aux paragraphes 1 à 9 pour le producteur communautaire et des niveaux calculés de production autorisés pour le producteur d'un pays tiers en vertu du protocole et à la législation nationale applicable.

(17) Whereas, where the rate of refund is differentiated according to the destination of the exported products, proof should be furnished that the product concerned has been imported into a third country; whereas completion of customs import formalities consists notably in the payment of import duties applicable in order that the product may be marketed in the third country concerned; whereas considering the diversity of situations prevailing in the importing third countries, it is advisable to accept the production of customs import documents which give assurances that the products exported have arrived at their destination, whilst hindering trade as little as possible;
(17) considérant que, dans le cas où le taux de la restitution est différencié en fonction de la destination des produits exportés, la preuve doit être apportée que le produit en cause a été importé dans un pays tiers; que l'accomplissement des formalités douanières d'importation consiste notamment dans le paiement des droits à l'importation applicables pour que le produit puisse être commercialisé sur le marché du pays tiers concerné; que, compte tenu des diversités de situations existant dans les pays tiers importateurs, il convient d'accepter la production des documents douaniers d'importation qui présentent une garantie d'arrivée à destination des produits exportés, tout en entravant le moins possible les échanges;

The release for free circulation, in the Principality of Andorra, of the textile products listed in Annex V to Council Regulation (EEC) No 3030/93 of 12 October 1993 on common rules for imports of certain textile products from third countries (*), Annexes IIIB, IV and V to Council Regulation (EC) No 517/94 of 7 March 1994 on common rules for imports of textile products from certain third countries not covered by bilateral agreements, protocols or other arrangements, or by other specific Community import rules (**) and Annex II to Council Regulation (EC) No 3060/95 of 22 December 1995 on the arrangements for imports of certain textile products originating in Taiwan (***) and products originating in the People's Republic of China listed in Annex II to Council Regulation (EC) No 519/94 of 7 March 1994 on common rules for imports from certain third countries (****) shall be subject to prior surveillance.
