In order to ensure uniform conditions for the implementation of this Regulation implementing powers should be conferred on the Commission with respect to: listing of the plants, plant products and other objects, and the respective third countries of origin or dispatch, for which a phytosanitary certificate is to be required for their introduction into the Union territory; listing of the plants, plant products and other objects, and the respective third countries of origin or dispatch, for which a phytosanitary certificate is to be required for their introduction into certain protected zones from those third countries; listing of the plants, plant products and other objects, the third countries concerned, and the maximum quantity subject to be exempted from the requirement for a phytosanitary certificate when introduced in the Union territory; and setting out technical arrangements concerning the invalidation of the electronic phytosanitary certificates.
Afin d'assurer des conditions uniformes d'exécution du présent règlement, il convient de conférer des compétences d'exécution à la Commission pour dresser la liste des végétaux, produits végétaux et autres objets, ainsi que des pays tiers d'origine ou d'expédition respectifs, dont l'introduction sur le territoire de l'Union requiert un certificat phytosanitaire; dresser la liste des végétaux, produits végétaux et autres objets, ainsi que des pays tiers d'origine ou d'expédition respectifs, dont l'introduction dans certaines zones protégées requiert un certificat phytosanitaire en provenance de ces pays tiers; dresser la liste des végétaux, produits végétaux et autres objets, les pays tiers concernés, et fixer la quantité maximale pouvant être exemptée de l'exigence de certificat phytosanitaire lors de l'introduction sur le territoire de l'Union; et définir les modalités techniques concernant l'annulation des certificats phytosanitaires électroniques.

The competent authority of the Member States concerned shall only approve slaughterhouses, cutting plants and meat processing establishments for the purposes of Articles 4, 5 and 6 and Article 11(2) in which the production, storage and processing of the fresh pig meat and pig meat preparations and pig meat products consisting of or containing such pig meat eligible for dispatch to other Member States and third countries in accordance with the derogations provided for in Articles 4 to 6 and 11(2), is carried out separately from the production, storage and processing of other products consisting of or containing fresh pig meat and pig meat preparations and pig meat products consisting of or containing meat derived from pigs originating in or coming from holdings located in areas listed in the Annex other than those approved in accordance with this Article.

nevertheless, where an agricultural or other product or a foodstuff possesses particular characteristics which are due to its geographical origin, it is possible for the producers of the product or foodstuff to apply, through the competent authorities of the Member State concerned, for registration at Community level of a protected designation of origin (PDO) or a protected geographical indication (PGI) in accordance with the provisions of Council Regulation No 510/2006 of 20 March 2006 on the protection of geographical indications and designations of origin for agricultural products and foodstuffs ; the granting of registration means that the Community has recognised the existence of very close links between the specific qualities of the product concerned and its geographical origin; in such cases, the common interest does not oppose the granting of aid for advertising which includes a reference to the origin of the product concerned, provided that the references to origin correspond exactly to those references which have been registered by the Community; similar considerations apply to other designations of origin which are protected under Community legislation, for example wines produced in specified regions in accordance with Articles 54–58 of Council Regulation (EC) No 1493/1999 of 17 May on the common organisation of the market in wine

In order to ensure uniform conditions for the implementation of this Regulation, implementing powers should be conferred on the Commission as regards laying down rules on the form of the product specification; laying down detailed rules on the form and content of the register of protected designations of origin and protected geographical indications; defining the technical characteristics of the Union symbols and indications as well as the rules on their use on products, including the appropriate linguistic versions to be used; granting and extending transitional periods for temporary derogations for use of protected designations of origin and protected geographical indication; laying down detailed rules on the form and content of the register of traditional specialities guaranteed; laying down rules for the protection of traditional specialities guaranteed; laying down all measures relating to forms, procedures and other technical details for the application of Title IV; laying down rules for the use of optional quality terms; laying down rules for the uniform protection of indications, abbreviations and symbols referring to the quality schemes; laying down detailed rules on the procedure, form and presentation of applications for registration and of oppositions; rejecting the application; deciding on the registration of a name if an agreement has not been reached; laying down detailed rules on the procedure, form and presentation of an amendment application; cancelling the registration of a protected designation of origin, a protected geographical indication or a traditional speciality guaranteed; and laying down detailed rules on the procedure and form of the cancellation process and on the presentation of the requests for cancellation.

During the consultation organised by the Commission in 2004, some Member States and various interested bodies (industries, trade unions, consumers and other institutions) declared that they were increasingly worried by the growing numbers of misleading and/or fraudulent indications of origin appearing on imported products and asked for rules to be drawn up making it mandatory for imports and/or EU products to be marked with their origin. The proposal submitted in 2005 by the Commission made it possible to envisage determining the origin of a product, at least partially, through Customs rules.

Neither Party shall allow a product to be labelled as originating in the other Party where such product is the result of the mixing of wines originating in the other Party and wines originating in that Party or a third country.
