2. Before making a pyrotechnic article available on the market distributors shall verify that the pyrotechnic article bears the CE marking, that it is accompanied by the required documents, and by instructions and safety information in a language which can be easily understood by consumers and other end-users in the Member State in which the pyrotechnic article is to be made available on the market, and that the manufacturer and the importer have complied with the requirements set out in Article 8(5) and (6) and Article 12(3) respectively.
2. The distributor makes a pyrotechnic article available on the market after it has been placed on the market by the manufacturer or the importer and should act with due care to ensure that his handling of the pyrotechnic article does not adversely affect the compliance of the pyrotechnic article.

The updated rules on making pyrotechnics articles available on the market is part of a Package of nine product safety directives (including also the Directive on non-automatic weighing instruments, measuring instruments, simple pressure vessels, lifts, explosives for civil uses, electromagnetic compatibility, low voltage electrical equipment and equipment used in explosive atmospheres) proposed by the Commission and constitute the first directive of the Package adopted by the EP today.

The basic aim is to reduce the risk of accidents caused by malfunctions and to increase consumer safety as sub-standard pyrotechnic articles will no longer be available on the EU market.
L’objectif fondamental est de réduire le risque d’accident dû à des dysfonctionnements ainsi que de renforcer la protection des consommateurs en éliminant les articles pyrotechniques de qualité insuffisante du marché de l’UE.
