Other changes to make the milk quota system more flexible as regards the fat adjustment, by abolishing the adjustment set out in Article 80(2) of Council Regulation (EC) No 1234/2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (the Single CMO Regulation) , and as regards the quota inactivity rules, by increasing the percentage in Article 72(2) of that Regulation which a producer should use during a twelve-month period and thus making it easier for unused quota to be reallocated, should also be made for the same reasons.

Therefore, the Canadian Turkey Marketing Agency, pursuant to paragraph 22(1)(f) of the Farm Products Marketing Agencies Act and section 2 of Part II of the schedule to the Canadian Turkey Marketing Agency Proclamation, C.R.C., c. 647, hereby revokes the Canadian Turkey Marketing Quota Regulations, C.R.C., c. 661, and makes the annexed Regulations respecting the establishment of a quota system by which quotas are assigned by provincial Commodity Boards to turkey producers for the marketing of turkey in interprovincial and export trade, in substitution therefor, effective May 2, 1990.

In performing the function referred to in section 2, a Provincial Commodity Board shall also apply the orders, regulations and rules of the province, if any, in respect of the allotment and administration of provincial quotas and provincial market development quotas, to the extent that they are not inconsistent with the Canadian Chicken Marketing Quota Regulations, in relation to the following matters:

Point 5 of Article 2 of Regulation (EC) No 318/2006 defines the production of quota sugar as the quantity of sugar production attributed to a specific marketing year under the quota of the undertaking concerned, and point 9 of Article 2 thereof defines quota beet as sugar beet processed into quota sugar.

In order to stimulate further the necessary restructuring, the surplus levy payable by the milk producers pursuant to Article 78(1) of Regulation (EC) No 1234/2007 should be calculated on the basis of the national quota reduced by the individual quotas bought-up under Article 75(1)(a), subject to the condition that those released quotas remain in the national reserve in the quota year concerned.
