(2) A series of legislative measures has been adopted at European level, opening up the rail freight and international rail passenger markets to competition and establishing, by way of Directive 2012/34/EU of the European Parliament and of the Council of 21 November 2012 establishing a single European railway area (recast), certain fundamental principles which include that railway undertakings shall be managed according to principles that apply to commercial companies, that entities responsible for the allocation of capacity and charging for rail infrastructure shall be separate from entities which operate rail services and that there shall be a separation of accounts, that any railway undertaking licensed in accordance with EU criteria should have access to railway infrastructure on fair, non-discriminatory terms, and that infrastructure managers may benefit from State financing.
(2) Une série de mesures législatives ont été adoptées au niveau européen, ouvrant à la concurrence le marché du fret ferroviaire ainsi que le marché des services internationaux de transport de voyageurs par chemin de fer et définissant certains principes fondamentaux dans la directive 2012/34/UE du Parlement européen et du Conseil, du 21 novembre 2012 établissant un espace ferroviaire unique européen (refonte). (2) 'infrastructure manager' means any body or firm responsible in particular for establishing, managing and maintaining railway infrastructure, including traffic management and control-command and signalling, in compliance with applicable safety rules; the essential functions of the infrastructure manager are: the decision making on train path allocation, including both the definition and the assessment of availability and the allocation of individual train paths and the decision making on infrastructure charging, including determination and collection of the charges, and investments in infrastructure;
2) "gestionnaire de l'infrastructure", tout organisme ou entreprise chargé notamment de l'établissement, de la gestion et de l'entretien de l'infrastructure ferroviaire, y compris la gestion du trafic, et du système de signalisation et de contrôle-commande, conformément aux règles de sécurité applicables; les fonctions essentielles du gestionnaire de l'infrastructure sont les suivantes: l'adoption des décisions concernant la répartition des sillons, y compris la définition et l'évaluation de la disponibilité, ainsi que l'attribution de sillons individuels et l'adoption des décisions concernant la tarification de l'infrastructure, y compris la détermination et le recouvrement des redevances, et les investissements dans l'infrastructure;

‧infrastructure manager‧ means any body or firm responsible in particular for establishing, managing and maintaining railway infrastructure, including traffic management and control-command and signalling; the functions of the infrastructure manager on a network or part of a network may be allocated to different bodies or firms;

Since private branch lines and sidings, such as sidings and lines in private industrial facilities, are not part of the railway infrastructure as defined by this Directive, managers of those infrastructures should not be subject to the obligations imposed on infrastructure managers under this Directive.
