4. Without prejudice to paragraph 3, Member States may exclude local and regional railway infrastructures which do not have any strategic importance for the functioning of the rail market from the application of Article 8(3) and local railway infrastructures which do not have any strategic importance for the functioning of the rail market from the application of Chapter IV. Member States shall notify the Commission of their intention to exclude such railway infrastructures.
4. In order to take into account the need of users, or potential users, of railway infrastructure capacity to plan their business, and the needs of customers and funders, it is important that infrastructure managers ensure that infrastructure capacity is allocated in a way which reflects the need to maintain and improve service reliability levels.
Afin de tenir compte de la nécessité pour les utilisateurs, ou utilisateurs potentiels, des capacités de l'infrastructure ferroviaire de planifier leurs opérations, ainsi que des besoins des clients et des bailleurs de fonds, il est important que les gestionnaires de l'infrastructure veillent à ce que les capacités de l'infrastructure soient attribuées d'une manière qui reflète la nécessité de maintenir et d'améliorer les niveaux de fiabilité du service.
