(49) In general, resolution authorities should apply the bail-in tool in a way that respects the hierarchy of claims established in this Directive, except where a different allocation of losses amongst liabilities of the same rank is necessary to preserve financial stability, or to minimise aggregate losses for the benefit of investors and society as a whole and is coherent with the statutory ranking of claims under the applicable insolvency law.
