Given that this issue creates confusion and problems in Community and national legislation, forcing citizens to have recourse to the ECJ, does the Commission not agree that a new EU proposal is required to determine the dividing line between the obligation to recognise professional qualifications and the powers granted to Member States to recognise educational diplomas, so as to avoid the danger of a levelling of qualifications between countries with huge differences in their educational systems?

(EN) On 23.10.2008 the European Court of Justice (ECJ) confirmed that Greece failed to fulfil its obligations under Directive 89/48/EEC because it did not recognise the diplomas awarded by the competent authorities of other Member States following education and training provided by a private body in Greece on the basis of a franchise agreement.
Le 23 octobre 2008 , la Cour de justice européenne (CJCE) a confirmé que la Grèce n’avait pas rempli les obligations qui lui incombaient en vertu de la directive 89/48/CEE parce qu’elle n’a pas reconnu les diplômes délivrés par les autorités compétentes d’autres États membres à la suite d’une formation dispensée par un organisme privé en Grèce sur la base d’un accord de franchise.

Each Member State with provisions in this field laid down by law, regulation or administrative action shall recognise the diplomas, certificates and other evidence of formal qualifications of dental practitioners specialising in orthodontics and oral surgery awarded to nationals of Member States by other Member States in accordance with Articles 2 and 3 of Directive 78/687/EEC and which are listed in Annex B, by granting such qualifications the same effect in its territory as the diplomas, certificates and other evidence of formal qualifications which it itself awards".

Member States are to state their reasons for such decisions taken regarding the recognition of diplomas, certificates and other evidence of formal qualifications held by nurses responsible for general care, dental practitioners, veterinary surgeons, midwives, architects, pharmacists or doctors; where a Member State decides to recognise a diploma, certificate or other evidence of formal qualifications, it should be free to choose whether or not to state the reasons.

The following shall be treated in the same way as a diploma, within the meaning of the first subparagraph: any diploma, certificate or other qualification or any set of diplomas, certificates or other evidence of formal qualifications or any set of such diplomas, certificates or other evidence awarded by a competent authority in a Member State, if it is awarded on the successful completion of education and training received in the Community and recognised by a competent authority in a Member State as being of an equivalent level and if it confers the same rights in respect of the taking up and pursuit of a regulated intellectual profession in that Member State;
