As regards the compatibility of aid for the cessation of dairy production with the internal market and, in particular, the Commission's observation that the scheme does not seem to comply with point 88 of the Community Guidelines for State aid in the agriculture and forestry sector 2007 to 2013 (the ‘2007-2013 Guidelines’) , the French authorities argue that the aid scheme for the cessation of dairy production falls under Article 75 of Regulation (EC) No 1234/2007 and that the Commission should take this into account in its analysis.
En ce qui concerne la question de la compatibilité des ACAL avec le marché intérieur, et notamment l'observation de la Commission selon laquelle le dispositif ne semble pas conforme au point 88 des lignes directrices de la Communauté concernant les aides d'État dans le secteur agricole et forestier 2007-2013 (ci-après les «lignes directrices 2007-2013») , les autorités françaises font valoir que le dispositif d'ACAL s'inscrit dans le cadre de l'article 75 du règlement (CE) no 1234/2007 et que la Commission devrait tenir compte de ce dernier dans son analyse.

As regards the question of knowing whether the aid implemented serves the general interest of a sector suffering from overcapacity (points 144(a) to (e) of the 2007-2013 Guidelines), the French authorities, after drawing attention to the arguments set out in recital 26, would add that the circulars governing aid for the cessation of dairy production underline that part of the recovered quotas revert to the national reserve for redistribution in connection with the ordinary allocation of quotas and that there is a stated desire to redistribute quotas for the benefit of producers with the capacity to produce in excess of their initial reference quantity and thereby contribute to the competitiveness of the dairy sector by supporting its economic restructuring.
En ce qui concerne la question de savoir si l'aide mise en œuvre sert l'intérêt général d'un secteur en surcapacité [points 144 a) à 144 e) des lignes directrices 2007-2013], les autorités françaises, après avoir rappelé les arguments exposés au considérant 26, ajoutent que les circulaires régissant le dispositif d'ACAL soulignent qu'une partie des quotas récupérés est reversée à la réserve nationale pour être redistribuée dans le cadre des attributions habituelles de quotas et que la volonté affichée est d'organiser une redistribution au profit des producteurs ayant la capacité de produire au-delà de leur quantité de référence initiale, et d'œuvrer ainsi en faveur de la compétitivité du secteur laitier en accompagnant sa restructuration économique.
