This proposal seeks to amend Regulation (EC) No 1049/2001 in light of the European Parliament’s motion for a resolution of 4 April 2006 on access to the institutions’ texts (A6-0052/2006), the Regulation (EC) No 1367/2006 of 6 September 2006 on the Aarhus Convention, and the public consultation on the review of the Regulation (EC) No 1049/2001 (SEC(2008) 29/2).

The applicant, a French association approved for environmental protection activities, seeks, on the basis of Article 10 of Regulation No 1367/2006, the review of Commission Implementing Regulation (EU) No 359/2012 of 25 April 2012 approving the active substance metam (1) By decision of 16 August 2012, the Commission refused to carry out that review on the ground that the implementing regulation of which review is sought does not constitute an administrative act within the meaning of Article 2(1)(g) of Regulation No 1367/2006 (2)
La partie requérante, une association française agréée pour la protection de l’environnement, souhaite obtenir, sur le fondement de l’article 10 du règlement no 1367/2006, le réexamen du règlement d’exécution no 359/2012 portant approbation de la substance active métam (1). Par décision du 16 août 2012, la Commission a refusé ce réexamen au motif que le règlement d’exécution dont le réexamen est demandé ne constitue par un acte administratif au sens de l’article 2, paragraphe 1, sous g), du règlement no 1367/2006 (2).

The Commission shall make the information in paragraph 3 publicly available in accordance with Regulation (EC) No 1367/2006 of the European Parliament and of the Council of 6 September 2006 on the application of the provisions of the Aarhus Convention on Access to Information, Public Participation in Decision-making and Access to Justice in Environmental Matters to Community institutions and bodies.
4.
