In that context and in the light of the Commission’s own assessment of the application of the Directive, taking into account views expressed by Member States and European social partners during the consultation process for this report, the Commission takes the view that no amendments are necessary at this stage.

As announced in the Communication on the application of the Unfair Commercial Practices Directive accompanying this Report, it does not seem appropriate to amend the Directive at this stage.

– (DE Mr President, the rapporteurs Duff and Voggenhuber, as well as the Committee on Constitutional Affairs, have done some sterling work. The report itself is sound because it conveys the key messages without going so far as to anticipate the work of the fundamental rights convention. I therefore nurture the hope that tomorrow in plenary sitting, this report will be adopted in the form we in the Committee on Citizens’ Freedoms and Rights drafted it in. However there is one point which I would like to be amended. I have tabled an amendment to this effect on behalf of my group. It concerns the question, raised repeatedly today, as to whether the European Union should sign up to the European Convention on Human Rights. This was an important goal in the past. It was an important and appropriate goal in the past precisely because there was no intention, at that stage, to create our own, autonomous catalogue of fundamental rights at European Union level; viewed in this light, it was far better to have that, as a second-best solution, than nothing at all.
- (DE) Monsieur le Président, les rapporteurs Duff et Voggenhuber et la commission des affaires constitutionnelles ont fait du bon travail. Le rapport est bon en tant que tel car il transmet les messages cruciaux sans pour autant anticiper sur le travail de la Convention. Je caresse donc l'espoir que demain, l'Assemblée plénière votera ce rapport tel que nous l'avons élaboré en commission des droits fondamentaux. Il est toutefois un point à propos duquel je souhaiterais une modification. J'ai d'ailleurs introduit, au nom de mon groupe, une proposition d'amendement à ce propos. Elle concerne le thème, plusieurs fois abordé aujourd'hui, de l'adhésion de l'Union européenne à la Convention européenne des droits de l'homme. Cette adhésion à la Convention était un objectif important dans le passé. C'était un objectif important et justifié dans le passé, aussi longtemps qu'il n'y avait pas de perspective de création d'un catalogue des droits fondamentaux propre à l'Union européenne. De ce point de vue, cette solution de second choix était bien meilleure que rien du tout.

4. The motions for second reading, concurrence at the report stage and for third reading of the said Bill and the adoption of any clause or title of the Bill or any procedural motion necessary for the adoption of the Bill in Committee of the Whole shall be deemed to have been carried on division; That the business to be considered under Government Orders on the morning of June 11, 1998, shall be the report stage of Bill C-38, An Act to amend the National Parks Act, followed by the third reading stage of Bill C-37, An Act to amend the Judges Act and to make consequential amendments to other Acts; provided that no later than 11:00 a.m. on that day, all questions necessary to dispose of the report stage of Bill C-38 shall be deemed to have been put and divisions thereon requested and deferred to 1:00 p.m. that day, and at 1:00 p.m. all questions necessary to dispose of the third reading stage of Bill C-37 shall be deemed to have been put and divisions thereon requested and deferred until immediately after completion of the divisions on Bill C-38; and That, during consideration of Government Orders on that day, a Member may propose a motion with respect to the amendments made by the Senate to Bill C-410, An Act to change the name of certain electoral districts.

The Commission considers that there does not appear to be sufficiently strong reasons to propose amendments to the Directive at this stage, and will review the situation when preparing the subsequent report on its application.
