C. whereas the necessary political dialogue started very late, when President Viktor Yanukovych met opposition leaders for the first time on 23 January; whereas the government resigned and the restrictive laws adopted on 16 January were repealed as a result of a first compromise reached in the Verkhovna Rada and signed by President Yanukovych; whereas the controversy over the law on amnesty continues to be an obstacle to any political solution; whereas the opposition insists that an amnesty should be granted to protesters without conditions, whilst the President and acting government insist that the occupation of all government buildings in the city of Kyiv should end before the amnesty enters into force and refuse to allow parallel political power structures;

B. whereas, having started as pro-European demonstrations, the focus of the protests has switched to more domestic issues and spread to other cities; whereas protestors have been demanding the government’s resignation, the organisation of new parliamentary and presidential elections, the release of demonstrators who have been arrested and the repeal of the restrictive laws adopted by the Ukrainian Parliament on 16 January 2014 and signed by the President the next day;
B. considérant que, nés sous la forme de manifestations pro-européennes, ces rassemblements ont évolué vers des thématiques plus nationales et ont gagné d'autres villes; considérant que les manifestants réclament le départ du gouvernement, la tenue de nouvelles élections législatives et présidentielles, la libération des contestataires arrêtés et l'abrogation des lois restrictives adoptées par le Parlement le 16 janvier et signées par le président dès le lendemain;

C. whereas the Russian Federation, as a full member of the Council of Europe and the Organisation for Security and Cooperation in Europe (OSCE) and a signatory to the Universal Declaration of Human Rights, has committed itself to the universal principles of democracy, the rule of law and respect for fundamental freedoms and human rights; whereas, as a result of numerous serious violations of the rule of law and the adoption in recent years of restrictive laws which contain ambiguous provisions that are used to further restrict opposition and civil society actors and to hinder the freedoms of expression and assembly, Russia is failing to comply with its international and national obligations;
C. considérant que la Fédération de Russie, en tant que membre à part entière du Conseil de l'Europe et de l'Organisation pour la sécurité et la coopération en Europe (OSCE) et que signataire de la déclaration universelle des droits de l'homme, s'est engagée à respecter les principes universels de la démocratie et de l'état de droit ainsi que les libertés fondamentales et les droits de l'homme; considérant qu'en raison des multiples violations graves de l'état de droit et de l'adoption, ces dernières années, d'une série de lois restrictives qui contiennent des dispositions ambiguës qui sont utilisées pour restreindre encore l'action de l'opposition et de la société civile et limiter la liberté d'expression et de réunion, la Russie ne respecte pas ses engagements internationaux et nationaux;

15. Strongly condemns the adoption by the Legislative Assembly of St Petersburg of a law against propaganda on sexual orientation; equally condemns similar laws adopted in the Ryazan, Arkhangelsk and Kostroma regions; calls on all Russian authorities to stop restricting freedom of expression in relation to sexual orientation or gender identity, in line with the European Convention on Human Rights and the International Covenant on Civil and Political Rights; calls on the Vice-President of the Commission/High Representative to convey the European Union's opposition to these laws;
15. condamne vivement l'adoption par l'Assemblée législative de Saint-Pétersbourg d'une loi contre la propagande en matière d'orientation sexuelle; condamne également les dispositions comparables adoptées dans les régions de Ryazan, d'Arkhangelsk et de Kostroma; demande aux autorités russes de cesser de restreindre la liberté d'expression en matière d'orientation sexuelle ou d'identité de genre, conformément à la convention européenne des droits de l'homme et au pacte international sur les droits civils et politiques; invite la haute représentante/vice-présidente de la Commission à exprimer l'opposition de l'Union européenne à ces dispositions;

Welcomes the adoption and entry into force on 1 June 2005 of six important pieces of legislation, a step which was established by the European Council in December 2004 as a condition for the opening of the negotiations; notes that concerns remain about certain elements of the laws adopted; is in particular concerned about the complaints made by the public prosecutor against Orhan Pamuk which are in breach of the European Convention for the Protection of Human Rights and Fundamental Freedoms, and calls on the Turkish Government to guarantee freedom of opinion and to further reform the penal code with regard, in particular, to Article 301/1 thereof; also expresses its concern about Article 305 of the Turkish Penal Code, which criminalises 'acts against the fundamental national interest', and a regulation implementing the law on associations, which retains a number of restrictions, including a priori authorisation of foreign funding; notes that serious concerns also remain regarding the insufficient legal proposals regarding the functioning of religious communities (Law on Foundations);

BACKGROUND The Merchant Shipping Act is a law adopted by the United Kingdom which entered into force on 1 December 1988.
