IN-CONTEXT TRANSLATIONS

(2) Subject to sections 33 and 34 and subsection (3), the Minister, with the approval of the Treasury Board, may provide insurance on any loan made by a private lender to an individual, firm or corporation engaged or about to engage in the business of general contracting or special trades contracting in Canada, if, in the opinion of the Minister, the individual, firm or corporation requires a loan to restructure his or its operations in order to improve his or its position in international trade competition and the restructuring will improve his or its capability to undertake foreign turnkey and other capital projects that would result in significant benefits to Canada.
(2) Sous réserve des articles 33 et 34 et du paragraphe (3), le ministre peut, avec l’approbation du Conseil du Trésor, assurer un prêt privé consenti à un particulier, à une société ou à une corporation exploitant ou sur le point d’exploiter, au Canada, une entreprise générale ou une entreprise spécialisée si, à son avis, le particulier, la société ou la corporation a besoin d’un prêt pour restructurer son exploitation, de façon à mieux soutenir la concurrence sur les marchés internationaux et à pouvoir entreprendre un plus grand nombre de projets étrangers «clés en main» et d’autres projets d’investissement offrant d’importants avantages pour le Canada.

(2) Subject to subsection (3), the Minister may provide insurance on a loan made by a private lender to a corporation engaged in a manufacturing or processing activity in Canada and incorporated under the laws of Canada or a province for the purpose of restructuring its operations if in the opinion of the Minister the corporation requires the loan to restructure its operations as a result of the acquisition of its effective ownership control by an individual, firm or corporation.

(a) the industry in Canada generally is undergoing significant economic adjustment of a non-cyclical nature by reason of import competition or by reason of industrial restructuring implemented pursuant to a policy or program of the Government of Canada to encourage such restructuring; and

As we presented to you in November, these would include: in the coming restructuring, no involuntary layoffs or relocation of workers in major or regional carriers; surplus employees identified in the restructuring will have their economic future secured through attrition, early retirement incentives, voluntary severance options, leave of absence programs, voluntary transfers, or mitigating programs to be offered on a fair basis across the sector; a long-term program of worker assistance, with public support, to provide income support, training, job search, and relocation assistance, as well as priority access to jobs in the industry for displaced workers; current collective agreements to be honoured and pension rights protected in the restructuring; no export of jobs from Canada; and a process that will provide for full consultation with affected workers and the speedy resolution of disputes resulting from this bill of rights.
