Mr. Irwin Cotler (Mount Royal, Lib.): Mr. Speaker, I rise to express regret and concern at the decision of the Iranian Revolutionary Court to uphold the convictions of the 10 Iranian Jews, despite flagrant violations of the defendants' rights to a fair trial as guaranteed under Iranian law including: being held incommunicado in detention for over a year; denial of the right to the presumption of innocence; the absence of any evidence implicating the accused; denial of the right to counsel of their choice; and denial of the right to an independent judiciary as the Iranian Revolutionary Court serves as one and the same as investigator, prosecutor and judge.

Finally, on March 1 of this year, Maryam was brought before a revolutionary court, found guilty, and sentenced to seven years in prison for " spreading propaganda" and for " gathering and colluding" against the regime.

Encourages the EU to explore the possibility of extending technical assistance, in partnership with international organisations, to Iran with a view to assisting in the reform of the Code of Criminal Procedure currently envisaged by the Iranian parliament; expresses concern, in particular, over detainees’ inability to access an attorney during interrogations, over the serious allegations of abuse during pre-charge and pre-trial detention, and over the trials of civilians before revolutionary courts; stresses that independence from political interference and ensuring a free trial are key in developing a modern code of criminal procedure and essential in addressing human rights issues;

P. whereas Saeed Abedini, an Iranian-American pastor imprisoned in Iran since 26 September 2012, was sentenced on 27 January 2013 by a revolutionary court in Iran to an eight-year prison term on charges of disturbing national security by creating a network of Christian churches in private homes; whereas it is reported that Saeed Abedini has suffered physical and psychological abuse in prison;

6. Calls on the Iranian Government to cease the prosecution of journalists, writers and others in revolutionary courts and the special Court of the Clergy for expressing opinions that in no way threaten public order or national security as these terms are understood in international law;
