IN-CONTEXT TRANSLATIONS

This Regulation respects the fundamental rights and observes the principles recognised in particular by the Charter of Fundamental Rights of the European Union, in particular the right to the protection of personal data (Article 8), the freedom to conduct a business (Article 16), the right to consumer protection (Article 38), the right to an effective remedy and to a fair trial (Article 47), and the right not to be tried or punished twice for the same offence (Article 50), and has to be applied in accordance with those rights and principles.

The more uniform rules should not have the effect of amending or modifying the obligation to respect fundamental rights and freedoms of defendants as well as fundamental legal principles that apply to them as enshrined in Article 6 of the Treaty on European Union (TEU), such as the right to be heard and the right to an effective remedy and to a fair trial or the principle ‘ne bis in idem’.

In this regard, the Court points out that the Framework Decision, in itself, already provides for a procedure in compliance with the requirements of the Charter relating to the right to an effective remedy and to a fair trial , independently of the detailed arrangements chosen by the Member States for the purpose of giving effect to the Framework Decision.

In addition, the Regulation states that evidence obtained lawfully in one Member State is admissible in trial courts of all Member States, provided that the evidence was collected respecting the procedural rights as enshrined in Article 47 (the right to an effective remedy) and Article 48 (the presumption of innocence and right of defence) of the EU Charter of Fundamental Rights.

Secondly, the Court considers that that provision of the Framework Decision is compatible with the right to an effective judicial remedy and to a fair trial and the rights of the defence as recognised under the Charter of Fundamental Rights of the European Union.

I'd like to emphasize at the outset that there are many international human rights obligations that are either directly or indirectly implicated in the work of the CBSA on a day-to-day basis, from the right to seek and enjoy asylum from persecution, the absolute prohibition on returning any person to a state where there are substantial grounds for believing they would be in danger of being subjected to torture, the fundamental right to liberty, as well as the freedoms of association and expression and, quite critically, the right to an effective remedy for anyone who alleges that her or his rights have been violated — that right to an effective remedy being a cornerstone of the rule of law.
