Urges the Ukrainian authorities to ensure full respect for the right of all prisoners sentenced on politically motivated grounds, including Ms Tymoshenko, Mr Lutsenko and Mr Ivashchenko, to adequate medical assistance in an appropriate institution, for their right of unrestricted access to their lawyers and for the right to be visited by relatives and other people such as the EU ambassador; stresses the need for Ukraine to respect fully the legal and human rights of defendants and detainees, including the right to medical care, in line with international standards; condemns the use of force by prison guards against Yulia Timoshenko, and recalls the obligation of Ukraine to examine promptly and impartially any complaints of torture or other forms of cruel, inhuman or degrading treatment;
8. presse les autorités ukrainiennes de veiller au plein respect, pour tous les prisonniers condamnés pour des motifs politiques, y compris M Timochenko, M. Loutsenko et M. Calls for the Ukrainian authorities to establish an independent and impartial international legal panel to report on possible violations of fundamental rights and freedoms in the cases of Yulia Tymoshenko and other members of her government; notes with satisfaction the outcomes of the meeting of the President of the European Parliament, Mr Martin Schulz, with the Prime Minister of Ukraine, Mr Mykola Azarov, and expects the Ukrainian authorities to respond to the agreed proposal by providing guidelines for its prompt implementation so as to ensure, in cooperation with, and in support of, the Charité medical team, proper medical treatment for Ms Yulia Tymoshenko, as well as judicial scrutiny by an authoritative and competent EU personality of the appeal and cassation processes and future trials of the former Prime Minister of Ukraine;
9. invite les autorités ukrainiennes à instituer une commission juridique internationale indépendante et impartiale qui aurait pour mission de rendre compte des éventuelles violations des droits et des libertés fondamentaux dans les procès contre Ioulia Timochenko et d'autres membres de son gouvernement; note avec satisfaction les résultats des entretiens qu'ont eus son Président, M. Martin Schulz, et M. Calls on Ukrainian authorities to respect the rights of Yulia Tymoshenko and other former members of the government, including the right to honest, fair, independent and transparent appeal process; expresses its concern regarding violent treatment of former Prime Minister Yulia Tymoshenko, as reported by the Ukrainian Parliament Commissioner for Human Rights;
4. demande aux autorités ukrainiennes de garantir les droits de Ioulia Timochenko et des anciens membres du gouvernement, y compris le droit à une procédure d'appel impartiale, équitable, indépendante et transparente; se dit préoccupé par le traitement violent subi par l'ancien Premier ministre Ioulia Timochenko, dont fait état la déléguée parlementaire ukrainienne pour les droits de l’homme;

H. whereas in its preliminary report the Danish Helsinki Committee for Human Rights, which has been monitoring the judicial proceedings in the case against Yulia Tymoshenko, identified fundamental shortcomings on the part of the Ukrainian criminal justice system, which have negatively affected the protection of individual human rights and the rule of law;

With the arrest and conviction of former prime minister Yulia Tymoshenko, we are witnessing an erosion of democracy and human rights in Ukraine.
