Council Regulation (EC) No 1104/2008 of 24 October 2008 on migration from the Schengen Information System (SIS 1+) to the second generation Schengen Information System (SIS II) and Council Decision 2008/839/JHA of 24 October 2008 on migration from the Schengen Information System (SIS 1+) to the second generation Schengen Information System (SIS II) have been substantially amended.

Those acts expired on 31 December 2008 prior to the completion of the SIS II developments. They therefore needed to be supplemented firstly by Regulation (EC) No 1104/2008 and by Decision 2008/839/JHA and subsequently by this Regulation and Council Regulation (EU) No 1272/2012 of 20 December 2012 on migration from the Schengen Information System (SIS 1+) to the second generation Schengen Information System (SIS II) at the latest until the termination of the migration from SIS 1+ to SIS II or until a date to be fixed by the Council, acting in accordance with Regulation (EC) No 1987/2006 of the European Parliament and of the Council of 20 December 2006 on the establishment, operation and use of the second generation Schengen Information System (SIS II) and Council Decision 2007/533/JHA of 12 June 2007 on the establishment, operation and use of the second generation Schengen Information System (SIS II)
Ces deux actes ont expiré le 31 décembre 2008, avant l’achèvement des développements liés au SIS II. At those meetings, an examination of the proposal for a Council Regulation recasting Council Regulation (EC) No 1104/2008 of 24 October 2008 on migration from the Schengen Information System (SIS 1+) to the second generation Schengen Information System (SIS II) and Council Decision 2008/839/JHA of 24 October 2008 on migration from the Schengen Information System (SIS 1+) to the second generation Schengen Information System (SIS II) resulted in the Consultative Working Party’s establishing, by common accord, as follows.
Lors de ces réunions, l'examen de la proposition de règlement du Conseil concernant la refonte du règlement (CE) nº 1104/2008 du Conseil du 24 octobre 2008 relatif à la migration du système d'information Schengen (SIS 1+) vers le système d'information Schengen de deuxième génération (SIS II), et la décision 2008/839/JAI du Conseil du 24 octobre 2008 relative à la migration du système d'information Schengen (SIS 1+) vers le système d'information Schengen de deuxième génération (SIS II), a conduit le groupe consultatif à constater, d'un commun accord, ce qui suit.

The Schengen Information System (SIS 1+), set up pursuant to the provisions of Title IV of the 1990 Schengen Convention, shall be replaced by a new system, the Schengen Information System II (SIS II) or any alternative technical solution which is based on the best available technology and is reasonable in terms of a clear timetable for its implementation and cost-effectiveness .

It is indeed the practice in the current Schengen evaluation that the Member States concerned report to the Council on the measures to comply with the recommendations, as the evaluation mechanism is now under full responsibility of the Council. On that basis, and under current legislation, it is up to the Council to inform Parliament accordingly.
Il est en effet d’usage, dans l’évaluation de Schengen actuelle, que les États membres concernés rendent compte au Conseil des mesures prises pour respecter ces recommandations, vu que le mécanisme d’évaluation est actuellement sous l’entière responsabilité du Conseil. Sur cette base, et dans le cadre de la législation actuelle, il revient dès lors au Conseil de tenir le Parlement informé.
