With respect to the EU market apart from Germany, the Commission had based its 1993 decision on its finding that supply outside the Kali+Salz AG/MdK and SCPA grouping came from operators who did not appear to be able to attack the total market share of about 60% held by the duopoly and on the strong probability that there would be no effective competition between Kali+Salz AG/MdK and SCPA, in particular because of their long-standing close commercial links.
En ce qui concerne le marché de l'UE outre l'Allemagne, la Commission avait basé sa décision de 1993 sur son constat que la fusion créerait un duopole dominant entre Kali+Salz AG/MdK et le groupement SCPA. La Commission était arrivée à cette conclusion en vue que les autres fournisseurs ne seraient pas en mesure de concurrencer la part de marché conjointe du 60% et qu'aucune concurrence n'existerait entre Kali+Salz AG/MdK et SCPA dû aux liens exceptionnellement étroits entre les deux entreprises.
