I intend to raise this question of privilege in respect of certain words spoken in the Senate during debate on Inquiry No. 8, last Thursday, November 8, 2001, which words I believe thwarted my privileges to speak in the Senate and my privileges to move adjournments of debate and to request leave of the Senate to revert; and also in respect of certain senators' wrong assertions about my attendance in the Senate; and also in respect of the confusion that day about certain Senate rules, the resulting imposition of conditions contrary to Senate rules on my speaking in the Senate; and also in respect of the distraction of the Speaker by certain Table officers while I was speaking.
Celle-ci a trait à certains propos tenus au Sénat au cours du débat sur l'interpellation no 8, jeudi dernier 8 novembre 2001. J'estime que ces propos portaient atteinte à mon privilège de prendre la parole au Sénat, de proposer l'ajournement du débat et de demander au Sénat l'autorisation de revenir à un article précédent de l'ordre du jour. Je veux également parler des fausses affirmations de certains sénateurs au sujet de ma présence au Sénat ainsi que de la confusion qu'il y a eu ce jour-là relativement à certaines de nos règles, de l'imposition correspondante de conditions contraires aux dispositions du Règlement concernant mon droit de parole au Sénat, et aussi du fait que le Président a été distrait par certains greffiers au Bureau pendant que je parlais.

Pursuant to Rule 43(8), the Senate proceeded to the consideration of the Question of Privilege of the Honourable Senator Cools in respect of certain words spoken in the Senate during debate on Item 8 (inquiry) on Thursday, November 8, 2001, which words she believes thwarted her privileges to speak in the Senate, to move adjournments of debate, and to request leave of the Senate to revert; and also, in respect of certain Senators' wrong assertions about her attendance in the Senate; and also, in respect of the confusion that day about certain Senate rules, the resulting imposition of conditions, contrary to the Senate rules, on her speaking in the Senate; and also, in respect of the distraction of the Speaker by certain Table Officers while she was speaking.
Conformément au paragraphe 43(8) du Règlement, le Sénat aborde la question de privilège de l'honorable sénateur Cools relativement à certains propos qui ont été tenus au Sénat durant le débat sur le point 8 (interpellation), le jeudi 8 novembre 2001, des propos qu'elle croit contreviennent à ses privilèges de prendre la parole au Sénat, de proposer l'ajournement du débat et de demander la permission du Sénat de revenir sur un point à l'ordre du jour, ainsi que sur les déclarations erronées de certains sénateurs à propos de sa présence au Sénat, sur la confusion qui régnait ce jour-là à propos de certains articles du Règlement, sur l'imposition subséquente de conditions, contraires au Règlement, concernant son droit de parole au Sénat et, enfin, sur le fait que certains greffiers aient distrait le Président pendant son intervention.

Pursuant to Rule 43(7), the Honourable Senator Cools gave notice that she would raise a Question of Privilege in respect of certain words spoken in the Senate during debate on Item 8 (inquiry) on Thursday, November 8, 2001, which words she believes thwarted her privileges to speak in the Senate, to move adjournments of debate, and to request leave of the Senate to revert; and also, in respect of certain Senators' wrong assertions about her attendance in the Senate; and also, in respect of the confusion that day about certain Senate rules, the resulting imposition of conditions, contrary to the Senate rules, on her speaking in the Senate; and also, in respect of the distraction of the Speaker by certain Table Officers while she was speaking.

Citing the British parliamentary authority, Erskine May, Senator Taylor asked me, as Speaker, to consider two questions: whether the Senate can assert privilege when it involves the action of a member from the other place and whether the Senate has a case of constructive contempt based on the comments made by the Minister.
