The Court has ruled that Article 49 of the Treaty precludes a Member State from making the movement of the staff in question subject to restrictions such as an obligation to obtain a work permit, since to impose such a condition on the person providing services established in another Member State discriminates against that person in relation to his competitors established in the host country who are able to use their own staff without restrictions, and moreover affects his ability to provide the service (Rush Portuguesa Judgment, C-113/89 of 27 March 1990).
La Cour a estimé que l’article 49 du traité s'oppose à ce qu'un État membre soumette le déplacement du personnel en question à des conditions restrictives telles qu'une obligation de permis de travail. En effet, le fait d'imposer une telle condition au prestataire de services d'un autre État membre le discrimine par rapport à ses concurrents établis dans le pays d'accueil, qui peuvent se servir librement de leur propre personnel, et affecte au surplus sa capacité de fournir la prestation (arrêt Rush Portuguesa, C-113/89 du 27 mars 1990).

Restrictions of this kind are contrary to Article 49 of the Treaty (free movement of services) and the case law of the Court of Justice in its judgements Rush Portuguesa C-113/89 of 27/3/90 and Vander Elst C-43/93 of 9/8/94.

The undertakings covered by the Directive must fall within one of the following three categories: 1) main contractor or sub-contractors which, in the course of carrying out a contract for services, post a worker to carry out temporary work in the territory of a Member State on behalf of and under the direction of that undertaking (the "Rush Portuguesa" case); 2) temporary employment businesses which place a worker with a user undertaking operating in a Member State to carry out temporary work in as far as there is an employment relationship between the temporary employment business and the worker (the "Seco" case); 3) undertakings which place a worker with one of their establishments or with another undertaking, whether an associated undertaking or not, established in another Member State to carry out temporary work (intra-firm or intra-group mobility).
Les entreprises couvertes doivent appartenir à l'une des trois catégories suivantes : 1) maître d'oeuvre ou sous-traitant qui, au titre de l'exécution d'un contrat de service, détache un travailleur en vue d'exécuter, à titre temporaire, un travail sur le territoire d'un Etat membre pour le compte et sous la direction de ladite entreprise (affaire "Rush Portuguesa"); 2) entreprise de travail temporaire qui met un travailleur à la disposition d'une entreprise utilisatrice exerçant son activité dans un Etat membre en vue d'y exécuter un travail, à titre temporaire, pour autant qu'il existe une relation de travail entre l'entreprise de travail temporaire et le travailleur (affaire "Seco"); 3) entreprise qui met un travailleur à la disposition de l'un de ses établissements ou d'une autre entreprise, associée ou non, établie dans un autre Etat membre en vue d'y exécuter un travail à titre temporaire (mobilité intra-entreprise ou intra-groupe).
