IN-CONTEXT TRANSLATIONS

The EESC notes that the third recital of the preamble, and specifically Article 151 of the TFEU, are intended to promote improved living and working conditions ‘so as to make possible their harmonisation while the improvement is being maintained’ and expressly calls for a ‘Social Progress Protocol’ to be included in the Treaties in order to enshrine the principle of the equal value of fundamental social rights and economic freedoms and thereby make it clear that neither economic freedoms nor competition rules should be allowed to take precedence over fundamental social rights, and also to clearly define the impact of the Union's objective of achieving social progress (1).
Il fait observer que le 3e considérant du Préambule, et plus concrètement l’article 151 du TFUE, stipulent déjà que l'un des objectifs est l'amélioration des conditions de vie et de travail «permettant leur égalisation dans le progrès». Le Comité demande expressément qu'un «protocole sur le progrès social» soit intégré dans les traités, afin de consacrer l'équivalence entre les droits sociaux et les libertés économiques fondamentaux et de préciser ainsi que ni les libertés économiques, ni les règles de concurrence ne peuvent prendre le pas sur les droits sociaux fondamentaux, et afin de définir clairement la portée de l'objectif de réaliser le progrès social qui a été assigné à l'Union (1).

8. Calls on the Commission to show greater rigour in implementing GSP+ by making recommendations to the beneficiary governments and to activate the oversight arrangements provided for in Council Regulation (EC) No 980/2005 of 27 June 2005 applying a scheme of generalised tariff preferences and, where necessary, apply the mechanisms for temporarily suspending preferences in respect of those countries which do not honour their commitments and which seriously and systematically breach fundamental social rights while ensuring that the cancellation of preferences does not encourage protectionism; calls also for monitoring and the application of those mechanisms to be extended to cover the countries benefiting under GSP+, especially as regards child and forced labour, the elimination of which are a central challenge for the ILO, as indicated in its report entitled "The end of child labour: Within reach";
8. invite la Commission à faire preuve de davantage de rigueur dans la mise en œuvre du SPG+ en formulant des recommandations à l'égard des gouvernements bénéficiaires et à activer les instruments de contrôle prévus dans le règlement (CE) n° 980/2005 du Conseil du 27 juin 2005 portant application d'un schéma de préférences tarifaires généralisées et, le cas échéant, à appliquer les mécanismes de suspension temporaire des préférences vis-à-vis des pays qui ne respectent pas leurs engagements et violent de manière grave et systématique les droits sociaux fondamentaux, tout en veillant à ce que la suppression des préférences ne favorise pas le protectionnisme; demande également que la surveillance et l'application de ces mécanismes soient étendues aux pays bénéficiaires du SPG+, tout particulièrement en ce qui concerne le travail des enfants et le travail forcé, dont l'élimination est un défi primordial pour l'OIT, ainsi qu'elle le signale dans son rapport intitulé "La fin du travail des enfants: un objectif à notre portée";

The Union and the Member States, having in mind fundamental social rights such as those set out in the European Social Charter signed at Turin on 18 October 1961 and in the 1989 Community Charter of the Fundamental Social Rights of Workers, shall have as their objectives the promotion of employment, improved living and working conditions, so as to make possible their harmonisation while the improvement is being maintained, proper social protection, dialogue between management and labour, the development of human resources with a view to lasting high employment and the combating of exclusion.
