The provisions of Article 45a of the Staff Regulations concerning the certification procedure, being derogating provisions designed to allow officials in the assistants function group (AST) to be appointed to posts in the administrators function group (AD) under the special conditions laid down therein, must be interpreted and applied restrictively.
S’agissant de dispositions dérogatoires visant à permettre la nomination de fonctionnaires du groupe de fonctions des assistants (AST) aux emplois du groupe de fonctions des administrateurs (AD) dans les conditions particulières qu’elles établissent, les dispositions de l’article 45 bis du statut relatives à la procédure de certification doivent être interprétées et appliquées de façon stricte.

Where there is a significant deterioration in the financial situation of an institution or where there are serious violations of law, regulations or bylaws or serious administrative irregularities, and other measures taken in accordance with Article 2 are not sufficient to reverse that deterioration Member States shall ensure that competent authorities may appoint a special manager to replace the management of the institution.

As regards the financial contribution of EU officials with excluded children with special educational needs the Commission referred to the new Article 1d(4)of the Staff Regulations, which entered into force on 1 May 2004, and pointed out that the principle of proportionality which governs relations between the Appointing Authority and the potential official should also be taken into account mutatis mutandis in relation to the obligations of the Appointing Authority towards the child of an official when that child has disabilities.

I call on the Commission to appoint a special task force to oversee the implementation and the enforcement of regulations in the countries concerned.
