Invites the Council, subject to substantial progress being made in the negotiations on the nuclear issue, to start a discussion on specific steps that could lead to an improvement in bilateral relations between the EU and Iran, including a possible future contractual framework for these relations and the development of sectoral cooperation, focusing for example on the development of civil society and the private sector in Iran, as well as on the areas of the fight against narcotic drugs (while ensuring that suspects receive a fair trial and are not subjected to the death penalty), environmental cooperation, technology transfer, infrastructure development and planning, education and culture, child protection and health, and common initiatives to promote and protect human rights; is concerned about the possible outbreak of infectious diseases such as polio and measles, especially among children, and urges the EU to ease access to relevant medication which has otherwise been difficult to obtain because of the sanctions;

By its appeal, the French Republic seeks to have set aside the judgment of the Court of First Instance of the European Communities of 4 December 2008 in Case T‑284/08 People’s Mojahedin Organisation of Iran v Council [2008] ECR I‑3487 (‘the judgment under appeal’), by which that court upheld the action brought by the People’s Mojahedin Organization of Iran (‘the PMOI’) for annulment of Council Decision 2008/583/EC of 15 July 2008 implementing Article 2(3) of Regulation (EC) No 2580/2001 on specific restrictive measures directed against certain persons and entities with a view to combating terrorism and repealing Decision 2007/868/EC (OJ 2008 L 188, p. 21, ‘the contested decision’), insofar as it concerned the PMOI.
Par son pourvoi, la République française demande l’annulation de l’arrêt du Tribunal de première instance des Communautés européennes du 4 décembre 2008, People’s Mojahedin Organization of Iran/Conseil (T‑284/08, Rec. p. II‑3487, ci-après l’«arrêt attaqué»), par lequel celui-ci a accueilli le recours de la People’s Mojahedin Organization of Iran (ci-après la «PMOI») tendant à l’annulation de la décision 2008/583/CE du Conseil, du 15 juillet 2008, mettant en œuvre l’article 2, paragraphe 3, du règlement (CE) nº 2580/2001 concernant l’adoption de mesures restrictives spécifiques à l’encontre de certaines personnes et entités dans le cadre de la lutte contre le terrorisme, et abrogeant la décision 2007/868/CE (JO L 188, p. 21, ci-après la «décision litigieuse»), pour autant qu’elle concerne la PMOI.

The power to amend the lists in Annexes VII and VIII to this Regulation should be exercised by the Council, in view of the specific threat to international peace and security posed by Iran as manifested by the deepening concern about its nuclear programme underlined by the European Council on 17 June 2010, and to ensure consistency with the process for amending and reviewing Annexes I and II to Decision 2010/413/CFSP.

5. Calls on the Iranian authorities to meet their international human rights commitments, and more specifically to respect the right of peaceful assembly enshrined in the International Covenant on Civil and Political Rights signed and ratified by Iran;

Paragraphs 1 and 2 shall not apply to a transfer by or through the Central Bank of Iran of funds or economic resources received and frozen after the date of its designation or to a transfer of funds or economic resources to or through the Central Bank of Iran after the date of its designation where such transfer is related to a payment by a non-designated financial institution due in connection with a specific trade contract, provided that the relevant Member State has determined, on a case-by-case basis, that the payment is not directly or indirectly received by a person or entity referred to in paragraph 1.
