To respond to the proliferation of racist and xenophobic hate speech online, the European Commission and four major IT companies (Facebook, Microsoft, Twitter and YouTube) presented a “Code of conduct on countering illegal hate speech online" in May 2016.

The Commission together with Facebook, Twitter, YouTube and Microsoft (“the IT companies”) today unveil a code of conduct that includes a series of commitments to combat the spread of illegal hate speech online in Europe.

However, if we look at what has actually happened at the tribunal, the vast majority of hate speech cases that have been prosecuted by the Canadian Human Rights Tribunal, or the commission at the tribunal, have been at the behest of a single complainant — an individual who used to work at the commission and who had a personal mission to go out and deal with hate speech on the Internet.

As you may know, I wrote a report for the Canadian Human Rights Commission several years ago in which I recommended the repeal of section 13, so that the commission and the tribunal would no longer deal with hate speech claims, and, in particular, hate speech on the Internet.
