Definition: A wide variety of medicaments and folk remedies may be involved, but the particularly important groups are: (a) psychotropic drugs that do not produce dependence, such as antidepressants, (b) laxatives, and (c) analgesics that may be purchased without medical prescription, such as aspirin and paracetamol. Persistent use of these substances often involves unnecessary contacts with medical professionals or supporting staff, and is sometimes accompanied by harmful physical effects of the substances. Attempts to dissuade or forbid the use of the substance are often met with resistance; for laxatives and analgesics this may be in spite of warnings about (or even the development of) physical harm such as renal dysfunction or electrolyte disturbances. Second plea in law, alleging (i) infringement of the principle that the provisions of EU law are to be interpreted having regard to their context and of the obligation to state reasons, in that the CST, in paragraphs 64 to 70 of its order, interpreted Article 56 of the Staff Regulations of Officials of the European Union without having regard either to Article 55 of those regulations or to the decisions adopted by the CoR on that basis, and failed to respond to the appellant’s arguments derived from those provisions; and (ii) errors of law, in that the CST thus misinterpreted the scope and purpose of Articles 55 and 56 of the Staff Regulations and Article 3 of Annex VI to those regulations, and Articles 2 and 4 of Decision No 048/03 on the detailed rules for granting flat-rate allowances for overtime worked by certain officials in categories C and D who are required to work overtime on a regular basis (‘Decision No 48/03’).
Deuxième moyen, tiré de la violation du principe de l’interprétation des dispositions du droit de l’Union européenne en tenant compte de leur contexte et de l’obligation de motivation, en ce que le TFP, aux points 64 à 70 de son ordonnance, a interprété l’article 56 du statut des fonctionnaires de l’Union européenne sans tenir compte ni de son article 55, ni des décisions adoptées par le CdR sur cette base, et n’a pas répondu aux arguments que le requérant tirait de ces dispositions, ainsi que des erreurs de droit, en ce qu’il a ainsi méconnu la portée et l’objectif des articles 55 et 56 du statut et de l’article 3 de son Annexe VI, ainsi que des articles 2 et 4 de la décision no 048/03 concernant les modalités d’octroi des indemnités forfaitaires pour les heures supplémentaires effectuées par certains fonctionnaires des catégories C et D qui se trouvent obligés d’effectuer des heures supplémentaires sur une base régulière (ci-après la «décision no 48/03»).

It should be added that the applicant’s argument that the functions of an administrator in grade AD 5, as listed in Annex I, Section A, to the Staff Regulations, correspond inter alia to those of a junior lawyer, a junior economist or a junior scientist, and that this does not match the responsibilities that he undertakes on his own, without acting in a junior capacity in relation to another official or staff member, clearly fails to take into account the job description appearing in the vacancy notice, which gives as one of the main duties that of ‘[p]reparing briefings, notes and other documents . for the senior officials and [at a] political level’.

The applicant asserts, in essence, that EPSO infringed the obligation to state reasons, laid down in Article 25 of the Staff Regulations, in so far as it refused to provide him with several documents and pieces of information and, in particular, the questions on which he failed, the reasons why his answers were incorrect, and the assessment sheets used for the written and oral tests.

If the director fails to take action or confirms the initial decision or instruction and the member of staff believes that such confirmation does not constitute a reasonable response to his or her concern, the member of staff shall inform the relevant panel referred to in Article 23(3) in writing.

Annul: (a) the decision of 18 December 2012 in so far as the Appeals Committee, under Article 22 of the Staff Regulations and Note to Staff No 715 HR/PO/2012-0103 of 29 March 2012, dismissed the appeal against the applicant’s staff report for 2011; (b) the part of that staff report containing the appraisal, in so far as the applicant’s performance is not summarised as ‘Exceptional’ or ‘Very good’ and in so far as no proposal is made to promote him to Function D, together with the part which sets his objectives for 2012; (c) all connected, consequent and prior measures, including the promotions referred to in the note from the Director of Human Resources ‘2011 staff appraisal exercise, award of promotions and titles’ of May 2012, given that, in view of the appraisal made by the applicant’s line managers and challenged in this action, the EIB failed to take him into consideration in the point ‘Promotions from Function E to D’;
annuler: a) la décision du 18 décembre 2012, en ce que le comité de recours, en vertu de l’article 22 du règlement du personnel de la BEI et de la note au personnel HR/PO/2012-0103 du 29 mars 2013, a rejeté le recours formé par le requérant contre son rapport d’évaluation pour 2011; b) le rapport d’évaluation pour 2011, en ce qu’il ne résume pas les appréciations par la note globale «performance exceptionnelle» ou «très bonne performance» et, enfin, en ce qu’il ne propose pas le requérant pour la promotion à la fonction D, ainsi qu’en ce qui concerne la fixation de ses objectifs pour l’année 2012; c) tous les actes connexes, consécutifs et préalables, et notamment les promotions décidées en vertu de la note du directeur des ressources humaines de mai 2012, intitulée «Exercice d’évaluation du personnel pour 2011, attribution des promotions et titres», étant donné que, eu égard au jugement exprimé par ses supérieurs, aujourd’hui attaqué, la BEI a omis de prendre le requérant en considération pour les «promotions de la fonction E à la fonction D»;

If the hierarchical superior fails to take action or confirms the initial decision or instruction and the member of staff believes that such confirmation does not constitute a reasonable response to his or her concern, the member of staff shall inform the authorising officer by delegation in writing.

6. If he or she fails to take action, the member of staff shall inform in writing the panel referred to in Article 22(3).
