In that regard, in limiting access to an internal competition solely to officials and members of the temporary staff employed in its departments, an institution is merely applying Article 29(1)(b) of the Staff Regulations.

(3a) While the amendments to the Staff Regulations introduced by this Regulation will result in some savings for the Union budget, they should in no way pre-empt upcoming decisions on changes in the staffing of Union institutions and agencies, which fall within the sole remit of the budgetary authority.

Until 30 June 2014, with regard to those officials who have been transferred to the EEAS pursuant to Council Decision 2010/427/EU, by way of derogation from Articles 4 and 29 of these Staff Regulations and under the conditions set out in Article 7(1), the Appointing Authorities of the institutions concerned may in exceptional cases, acting by common agreement and solely in the interest of the service, after having heard the official concerned, transfer such an EEAS official from the EEAS to a vacant post of the same grade in the General Secretariat of the Council or in the Commission without notifying the staff of the vacant post.

Its staff would be under the direction of the Board of Regulators but at the same time subject to the staff regulations of officials and the conditions of employment of other servants of the European Communities which bind Community servants to carry out their duties and conduct themselves solely with the interests of the Communities in mind and to carry out their duties objectively, impartially and loyally to the Communities.
