Thus, neither the fact that, in its decision ruling on an administrative complaint, an institution or agency responded to the substantive arguments put forward without touching on the possibility that the complaint had been submitted out of time and was therefore inadmissible nor the fact that that institution or agency expressly informed the person concerned that he had the option of contesting that decision before the courts has any effect on the Civil Service Tribunal’s assessment of whether the action subsequently brought against that decision is inadmissible: facts of that kind are not capable of establishing a derogation from the system of mandatory time-limits established by Articles 90 and 91 of the Staff Regulations, still less of exempting the Tribunal from its obligation to verify that the time-limits laid down in those regulations have been complied with.

First plea in law, alleging an error of law, since the Civil Service Tribunal (‘the CST’) held, first, that the failure, by the EEAS, to adopt the general provisions (‘GP’) of Article 10 of Annex X to the Staff Regulations of Officials of the European Union (‘the regulations’) was justified by the fact that the EEAS was still, as regards the application of that provision, in an adjustment period and, secondly, that the failure to fulfil the obligation to adopt the GP can be successfully invoked by the appellant only where he shows that the EEAS applied that provision arbitrarily.

The reasons for this are the fact that the main reform of the Staff Regulations, which produced substantial savings, took place few years ago and is still having effects and the necessity strictly to adhere to the calendar for the adoption of the changes currently proposed.

Recalls that, following the employment of the Agency's former Executive Director by a consultancy that advises, among others, pharmaceutical companies almost immediately after he left the Agency, the discharge authority raised concerns over the actual independence of the Agency and the way in which its Management Board implemented Article 16 of the Staff Regulations; is furthermore concerned by the allegations that the Agency's former Executive Director created his own consultancy firm while still in office; calls on the Agency to provide the discharge authority with further information on this matter by 30 June 2012;

At the same time, many of them – almost all of them, in fact – still have major surplus problems and problems complying with the Financial Regulation and the Staff Regulations year after year.

The Council notes here that the preliminary draft amendment of the Staff Regulations of officials and the conditions of employment of other servants of the European Communities, aimed at clarifying the rights and obligations of those persons in connection with fraud prevention and their judicial protection, which, at the time of adoption of the Regulations establishing OLAF, the Commission undertook to prepare, is still at the stage of consultations prior to submission of a legislative proposal.
