IN-CONTEXT TRANSLATIONS

4. For the reimbursement of flat-rate expenditure, or expenditure arising from the Staff Regulations of Officials of the European Union and the Conditions of Employment of Other Servants of the European Union (hereinafter ‘Staff Regulations’) which is fixed at a ceiling, and which is paid in a currency other than the euro, the rate to be used shall be that which is in force when the entitlement arises.
4. It should be noted, moreover, that the criteria required of candidates who were staff from the national diplomatic services of the Member States, in paragraph 2 of the second group of eligibility criteria, namely that they should have a level of education which corresponds to completed university studies of at least three years attested by a diploma, matches the criterion required in Article 5(3)(b)(i) of the Staff Regulations for appointment at grades 5 and 6 in the administrators’ function group (AD), a criterion which is very different from that required by Article 5(3)(c) of the Staff Regulations for appointment at grades 7 to 16 in the same function group.

The exercise of the broad discretion which the Staff Regulations confer on the institutions in the organisation of competitions must be compatible with the mandatory provisions of the first paragraph of Article 27 of the Staff Regulations, according to which the purpose of any recruitment procedure is to secure for the institution the services of officials of the highest standard of ability, efficiency and integrity, and with Article 29(1) of the Staff Regulations.

Similarly, Article 90(1) of the Staff Regulations, which applies to temporary staff pursuant to Article 46 of the CEOS, itself envisages a situation in which, on expiry of the four-month period from the date on which a request is made, the absence of a reply — of its nature without a statement of reasons — is deemed to constitute an implied decision rejecting it, such that the reasons set out by the AECE in that situation can be contested by the temporary staff member only at the contentious stage.

3. Notes with concern that in order to cover higher school fees, the Agency grants staff whose children attend primary or secondary school a top-up allowance which amounted to some EUR 23 000 in 2012, in addition to the education allowances provided for in the Staff Regulations of the Officials of the European Communities (‘the Staff Regulations’) ; notes that these allowances are not covered by the Staff Regulations and are, therefore, considered irregular by the Court of Auditors; acknowledges, however, that this situation is due to the lack of European Schools in the city the Agency is based in and that the purpose of these top-ups is to ensure equal treatment of the Agency’s employees under the Staff Regulations;
3. observe avec préoccupation qu'afin de couvrir des frais de scolarité plus élevés, l'Agence accorde à son personnel dont les enfants fréquentent un établissement d'enseignement primaire ou secondaire un supplément, qui s'est élevé à environ 23 000 EUR en 2012, s'ajoutant aux allocations scolaires prévues par le statut; observe que ces dépenses ne sont pas prévues par le statut et sont donc considérées comme irrégulières par la Cour des comptes; reconnaît, cependant, que cette situation est due à l'absence d'école européenne dans la ville où l'Agence est établie et que l'objectif de ces suppléments est d'assurer l'égalité de traitement des employés de l'Agence relevant du statut;

For the purposes of the present appeal, it must first be stated that the Civil Service Tribunal recalled that any decision relating to a specific individual which is taken under the Staff Regulations and adversely affects that person must state the reasons on which it is based, on the one hand, to enable the competent court to review the legality of the decision and, on the other, to provide the person concerned with the information necessary to allow him to ascertain whether or not the decision is well founded and to enable him to decide whether to bring an action. It added, however, referring to Case C‑254/95 P Parliament v Innamorati [1996] ECR I‑3423, paragraphs 24 to 28, that, as far as concerns decisions taken by a selection board in a competition, the obligation to state reasons must be reconciled with observance of the secrecy surrounding the proceedings of selection boards by virtue of Article 6 of Annex III to the Staff Regulations, secrecy which was instituted with a view to guaranteeing the independence of selection boards and the objectivity of their proceedings. Thus, observance of this secrecy precludes both disclosure of the attitudes adopted by individual members of selection boards and disclosure of any factors relating to individual or comparative assessments of candidates and that the obligation to state the reasons on which decisions of a selection board in a competition are based must take account of the nature of the proceedings concerned, which, at the stage of examination of the abilities of the candidates, are primarily comparative in character and accordingly covered by the secrecy inherent in those proceedings (paragraphs 30 and 31 of the judgment under appeal).
Aux fins du présent pourvoi, en premier lieu, il convient de relever que le Tribunal de la fonction publique a rappelé que toute décision individuelle prise en application du statut et faisant grief doit être motivée, et que l’obligation de motivation a pour objet, d’une part, de permettre au juge d’exercer son contrôle sur la légalité de la décision et, d’autre part, de fournir à l’intéressé les indications nécessaires pour savoir si la décision est ou non fondée et lui permettre d’apprécier l’opportunité de l’introduction d’un recours. Il a néanmoins ajouté, en faisant référence à l’arrêt de la Cour du 4 juillet 1996, Parlement/Innamorati (C‑254/95 P, Rec. p. I‑3423, points 24 à 28), que, en ce qui concerne les décisions prises par un jury de concours, l’obligation de motivation doit être conciliée avec le respect du secret qui entoure les travaux du jury en vertu de l’article 6 de l’annexe III du statut, secret institué en vue de garantir l’indépendance des jurys de concours et l’objectivité de leurs travaux. Ainsi, le respect de ce secret s’oppose à la divulgation tant des attitudes prises par les membres individuels des jurys que de tous éléments ayant trait à des appréciations de caractère personnel ou comparatif concernant les candidats, et l’exigence de motivation des décisions d’un jury de concours doit tenir compte de la nature des travaux en cause, lesquels, au stade de l’examen des aptitudes des candidats, sont avant tout de nature comparative et, de ce fait, couverts par le secret inhérent à ces travaux (points 30 et 31 de l’arrêt attaqué).

(a) in paragraph 1, the first sentence is replaced by the following: "The authorising officer shall be liable for payment of compensation as laid down in the Staff Regulations, which specify that a member of staff covered by the relevant provisions may be required to make good, in whole or in part, any damage suffered by the Communities as a result of serious misconduct on his/her part in the course of or in connection with the performance of his/her duties, in particular if he/she determines entitlements to be recovered or issues recovery orders, commits expenditure or signs a payment order without complying with this Regulation and the implementing rules".

As the House knows, we have from the outset been committed to providing reforms in the Staff Regulations which would facilitate radical modernisation whilst upholding the current conditions of employment and improving the career development of members of the European Union civil service.
Comme le sait l'Assemblée, depuis le début, nous nous sommes engagés à réformer le statut en vue de permettre une modernisation radicale tout en maintenant les conditions d'emploi actuelles et en améliorant l'évolution de la carrière des agents de la fonction publique de l'Union européenne.

Thus Article 12§1 of the Staff Regulations stipulates that "An official shall abstain from any action and, in particular, any public expression of opinion which may reflect on his (or her) position".

The current Staff Regulations, under which the maximum period for which auxiliary staff may be employed is limited to one year, has drawbacks in terms of both continuity of services and the 'attractiveness' of such employment if highly qualified staff are needed.
