In order to take into account the evolution of trade and market developments, the needs of the markets for ovalbumin and lactalbumin or the market for eggs and the results of the monitoring of the imports of ovalbumin and lactalbumin, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of rules making the import of ovalbumin and lactalbumin for release into free circulation subject to the presentation of an import licence, rules on the rights and obligations deriving from that import licence and its legal effects, the cases in which a tolerance applies as regards the obligation mentioned in the licence, rules making the issuing of an import licence and the release into free circulation subject to the presentation of a document issued by a third country or an entity certifying, inter alia, the origin, the provenance, the authenticity and the quality characteristics of the products, rules on the transfer of the import licences or restrictions on that transfer, the cases where the presentation of an import licence is not required and the cases where the lodging of the security guaranteeing that the products are imported within the period of validity of the licence is or is not required.
Afin de prendre en compte l’évolution des échanges et le développement des marchés, les besoins des marchés de l’ovalbumine et de la lactalbumine ou du marché des œufs et les résultats du suivi des importations d’ovalbumine et de lactalbumine, il convient de déléguer à la Commission le pouvoir d’adopter des actes conformément à l’article 290 du traité sur le fonctionnement de l’Union européenne en vue de prévoir des règles permettant de soumettre l’importation d’ovalbumine et de lactalbumine pour mise en libre pratique à la présentation d’une licence d’importation, à des règles sur les droits et obligations découlant de cette licence d’importation et ses effets juridiques, aux cas dans lesquels une tolérance s’applique à l’égard de l’obligation mentionnée dans la licence, à des règles sur la subordination de la délivrance de licences d’importation et la mise en libre pratique à la présentation d’un document délivré par un pays tiers ou une entité certifiant, entre autres, l’origine, la provenance, l’authenticité et les caractéristiques de qualité des produits, à des règles en matière de transfert des licences d’importation ou de restrictions à ce transfert, et en vue de déterminer les cas dans lesquels la présentation d’une licence d’importation n’est pas requise et les cas dans lesquels la constitution d’une garantie assurant que les produits sont importés pendant la période de validité de la licence n’est pas requise.

Nevertheless, it seems appropriate that articles, as defined in this Regulation, containing chemicals that could be released under certain conditions of use or disposal and that are banned or severely restricted in the Union within one or more of the use categories laid down in the Convention or are subject to the PIC procedure should also be subject to the export notification rules.

(3) Steps towards tax harmonisation within the Community have been taken by Council Directive 92/12/EEC of 25 February 1992 on the general arrangements for products subject to excise duty and on the holding, movement and monitoring of such products(3), as last amended by Directive 2000/47/EC(4) and Commission Regulations (EEC) No 2719/92 of 11 September 1992 on the accompanying administrative document for the movement under duty-suspension arrangements of products subject to excise duty(5), as last amended by Regulation (EEC) No 2225/93(6), and (EEC) No 3649/92 of 17 December 1992 on a simplified accompanying document for the intra-Community movement of products subject to excise duty which have been released for consumption in the Member State of dispatch(7).

2. If the preferential tariff treatment referred to in paragraph 1 in respect of the import goods is subject to tariff quotas or tariff ceilings, the application of the rate of duty referred to in paragraph 1 in respect of the processed products shall also be subject to the condition that the said preferential tariff treatment is applicable to the import goods at the time of acceptance of the declaration of release for free circulation.
2. Si le traitement tarifaire préférentiel visé au paragraphe 1 est prévu pour les marchandises d'importation dans le cadre de contingents tarifaires ou de plafonds tarifaires, l'application du taux du droit visé au paragraphe 1 à l'égard des produits transformés est également soumise à la condition que ledit traitement tarifaire préférentiel soit applicable aux marchandises d'importation au moment de l'acceptation de la déclaration de mise en libre pratique.
