Commission Regulation (EC) No 941/2009 of 8 October 2009 amending the representative prices and additional import duties for certain products in the sugar sector fixed by Regulation (EC) No 877/2009 for the 2009/2010 marketing year

1. In Member States which have granted the restructuring aid provided for in Article 3 of Regulation (EC) No 320/2006 for at least 50 % of the sugar quota fixed on 20 February 2006 in Annex III to Council Regulation (EC) No 318/2006 of 20 February 2006 on the common organisation of the markets in the sugar sector , aid shall be granted to sugar beet and cane producers under the conditions laid down in this Section.

Dans les États membres qui ont octroyé l'aide à la restructuration prévue à l'article 3 du règlement (CE) no 320/2006 pour 50 % au moins du quota de sucre fixé à l'annexe III du règlement (CE) no 318/2006 du Conseil du 20 février 2006 portant organisation commune des marchés dans le secteur du sucre , une aide communautaire est accordée aux producteurs de betteraves et de cannes à sucre, selon les conditions établies dans la présente section.

"2. Within the amount referred to in Annex IV, the Commission shall fix the maximum amount available to each Sugar Protocol country for financing the actions referred to in paragraph 1 on the basis of the needs of each country, related in particular to the impact of the reform of the sugar sector in the country concerned and to the importance of the sugar sector to the economy.
2. Dans les limites du montant visé à l'annexe IV, la Commission fixe le montant maximum disponible pour chaque pays signataire du protocole sur le sucre pour le financement des actions visées au paragraphe 1 en fonction des besoins de chaque pays, compte tenu notamment de l'incidence de la réforme du secteur du sucre dans le pays concerné et de l'importance du secteur du sucre dans l'économie.

The common organisation of markets in the sugar sector fixes sugar production quotas by Community region.

Except as otherwise provided by this Regulation, Commission Regulation (EC) No 1291/2000 of 9 June 2000, laying down common detailed rules for the application of the system of import and export licences and advance fixing certificates for agricultural products and the special rules applicable to the sugar sector laid down by Commission Regulation (EC) No 951/2006 of 30 June 2006 laying down detailed rules for applying Council Regulation (EC) No 318/2006 as regards trade with third countries in the sugar sector (new third country management Regulation) should apply to import licences issued under this Regulation.
Sauf disposition contraire prévue par le présent règlement, le règlement (CE) no 1291/2000 de la Commission du 9 juin 2000 portant modalités communes d'application du régime des certificats d'importation, d'exportation et de préfixation pour les produits agricoles ainsi que les modalités particulières applicables au secteur du sucre établies par le règlement (CE) no 951/2006 de la Commission du 30 juin 2006 portant modalités d'application du règlement (CE) no 318/2006 du Conseil en ce qui concerne les échanges avec les pays tiers dans le secteur du sucre (nouveau règlement «gestion des pays tiers») doivent s'appliquer aux certificats d'importation délivrés dans le cadre du présent règlement.

Within that overall amount, the Commission intends to fix the maximum amount available to each Sugar Protocol country on the basis of the needs of each country, in particular on the basis of the impact of the reform of the sugar sector in the country concerned and the importance of the sugar sector in the economy.
Dans le cadre de ce montant global, la Commission envisage de « fixer le montant maximum disponible pour chaque pays du Protocole sucre », « sur la base des besoins de chaque pays, en particulier en fonction de l’impact de la réforme du secteur du sucre dans le pays concerné et de l’importance du secteur du sucre dans l’économie ».

Within the overall amount available for the year of validity of this Regulation, the Commission shall fix the maximum amount available to each Sugar Protocol country for financing the actions referred to in Articles 3(3 ) and 4(3) , on the basis of the needs of each country, related in particular to the impact of the reform of the sugar sector in the country concerned and to the importance of the sugar sector to the economy.

Dans les limites du montant global disponible pour l'année d'application du présent règlement, la Commission fixe le montant maximum disponible pour chaque pays signataire du protocole sur le sucre pour le financement des actions mentionnées à l'article 3 , paragraphe 3, et à l'article 4, paragraphe 3, en fonction des besoins de chaque pays, en fonction notamment de l'incidence de la réforme du secteur du sucre dans le pays concerné et de l'importance du secteur du sucre dans l'économie.

In view of the financial perspective and the budgetary rules adopted by the European Council in Berlin in March 1999, the support prices in the sugar sector should be fixed for the whole duration of the new arrangements.
Compte tenu des perspectives financières et des règles de discipline budgétaire arrêtées par le Conseil européen à Berlin en mars 1999 il y a lieu de fixer les prix de soutien dans le secteur du sucre pour toute la période de durée du nouveau régime.

(2a) In view of the financial perspective and the budgetary rules adopted by the European Council in Berlin in March 1999, there is no need to make any substantive changes to the common organisation of the market in sugar as regards its operating principles, but the support prices in the sugar sector should be fixed for the whole duration of the new arrangements.
Ces garanties de prix données au sucre bénéficient de fait également aux sirops de saccharose comme à l'isoglucose et au sirop d'inuline, dont les prix sont fonction de ceux du sucre (2 bis) Compte tenu des perspectives financières et des règlements de discipline budgétaire arrêtés par le Conseil européen à Berlin en mars 1999, il n' y a pas lieu de modifier substantiellement l'organisation commune de marché du sucre dans ses principes de fonctionnement, mais il y a lieu de fixer les prix de soutien dans le secteur du sucre pour toute la période du nouveau régime.
