This concerns in particular Articles 14, 151, 152, 153, 165, 166 and 168 of the Treaty on the Functioning of the European Union (TFEU) and Protocol (No 26) on Services of General Interest annexed to the Treaty on European Union (TEU) and to the TFEU in accordance with which it remains the exclusive competence of the Member States to define the fundamental principles of their social security, vocational training and health systems and to shape the framework conditions for the management, financing, organisation and delivery of the services supplied within those systems, including - without prejudice to Article 168(4) TFEU and to Directive 2005/36/EC of the European Parliament and of the Council of 7 September 2005 on the recognition of professional qualifications - the definition of requirements, quality and safety standards applicable to them.

Imports: Examination of the arrangements for the supply of refineries and the ACP sugar, leads the Commission to conclude that it is necessary to provide a greater degree of security in the supplying of all so-called port refineries of the Community by the extension mutatis mutandis of the transitional preferential import arrangements currently in force for Portugal, as well as to provide within those arrangements an assured access to raw sugar originating from ACP and/or other States in conformity with the commitments undertaken by the Community within the framework of the agricultural Agreement resulting from the Uruguay Round of multi- national trade negotiations.

On 24 May 1996, the Commission adopted a statement of objections which envisages the Commission adopting a decision addressing the following four restrictions of competition (a) the price agreement relating to maritime transport; (b) the price agreement relating to inland transport services supplied within the territory of the Community; (c) the agreement between the parties to the TACA as to the terms and conditions on and under which they may enter into service contracts with shippers; and (d) the agreement between the parties to the TACA relating to the fixing of maximum levels of freight forwarder compensation. It proposes, as a preliminary view, (i) that each of these practices is found to fall within the scope of Article 85(1), (ii) that application for individual exemption is refused for those practices falling outside the scope of the group exemption and (iii) that the group exemption is withdrawn in respect of the activities falling within its scope.
