1. In the territorial sea of the host Member State or a participating Member State, the participating units shall take one or more of the following measures, subject to the authorisation of the Member State to which the territorial sea belongs, when there are reasonable grounds to suspect that a ship is carrying persons intending to circumvent checks at border crossing points or is engaged in the smuggling of migrants by sea:
1. If the suspicions that a ship is carrying persons intending to circumvent checks at border crossing points or is engaged in the smuggling of migrants by sea prove to be founded, the host Member State or the participating Member State to which the territorial sea belongs may take one or more of the following measures:

By way of derogation from Articles 5 and 8, Member States may authorise seamen holding a seafarer’s identity document issued in accordance with the International Labour Organization (ILO) Seafarers’ Identity Documents Convention No 108 (1958) or No 185 (2003), the Convention on Facilitation of International Maritime Traffic (FAL Convention) and the relevant national law, to enter the territory of the Member States by going ashore to stay in the area of the port where their ships call or in the adjacent municipalities, or exit the territory of the Member States by returning to their ships, without presenting themselves at a border crossing point, on condition that they appear on the crew list, which has previously been submitted for checking by the competent authorities, of the ship to which they belong.
Par dérogation aux articles 5 et 8, les États membres peuvent autoriser les marins munis d’une pièce d’identité des gens de mer, délivrée conformément aux conventions de l’Organisation internationale du travail (OIT) sur les pièces d’identité des gens de mer no 108 (de 1958) ou no 185 (de 2003), à la convention visant à faciliter le trafic maritime international (convention FAL) ainsi qu’au droit national pertinent, à entrer sur le territoire des États membres en se rendant à terre pour séjourner dans la localité du port où leur navire fait escale ou dans les communes limitrophes, ou à sortir du territoire des États membres en retournant sur leur navire, sans se présenter à un point de passage frontalier, à condition qu’ils figurent sur le rôle d’équipage, préalablement soumis à une vérification des autorités compétentes, du navire auquel ils appartiennent.

All funds and economic resources belonging to, owned, held or controlled by natural persons responsible for, actively supporting or implementing, actions or policies which undermine or threaten the territorial integrity, sovereignty and independence of Ukraine, or stability or security in Ukraine, or which obstruct the work of international organisations in Ukraine, and natural or legal persons, entities or bodies associated with them, or legal persons, entities or bodies in Crimea or Sevastopol whose ownership has been transferred contrary to Ukrainian law, or legal persons, entities or bodies which have benefited from such a transfer, as listed in the Annex, shall be frozen’.

(b) ‘intra-corporate transfer’ means the temporary transfer, for occupational purposes, of a third-country national not permanently resident within the territory of the Member States from an undertaking established outside the territory of a Member State and to which the third-country national is bound by a work contract to an entity belonging to the undertaking or to the same group of undertakings which is established inside this territory;
(b) "détachement intragroupe", le détachement temporaire à des fins professionnelles d'un ressortissant de pays tiers qui n'a pas sa résidence permanente sur le territoire des États membres, employé par une entreprise établie en dehors du territoire d'un État membre et à laquelle ce ressortissant est lié par un contrat de travail, dans une entité appartenant à ladite entreprise ou au même groupe d'entreprises établi sur ce territoire;

' intra-corporate transfer' means the temporary secondment for occupational or training purposes of a third-country national who, at the time of application for an intra-corporate transferee permit, resides outside the territory of the Member States, from an undertaking established outside the territory of a Member State, and to which the third-country national is bound by a work contract prior to and during the transfer , to an entity belonging to the undertaking or to the same group of undertakings which is established in that Member State, and, where applicable, the mobility between host entities established in one or several second Member States ;
«transfert temporaire intragroupe», le détachement temporaire à des fins professionnelles ou de formation d'un ressortissant de pays tiers qui, à la date de l'introduction de la demande de permis pour personne faisant l'objet d'un transfert temporaire intragroupe, réside en dehors du territoire des États membres, par une entreprise établie en dehors du territoire d'un État membre, et à laquelle ce ressortissant de pays tiers est lié par un contrat de travail avant et pendant le transfert temporaire, dans une entité appartenant à ladite entreprise ou au même groupe d'entreprises établie dans cet État membre et, le cas échéant, la mobilité entre des entités hôtes établies dans un ou plusieurs deuxièmes États membres;

2. Paragraph 1 shall not apply to exports to those territories of Member States which are both listed in Annex IV and are not part of the customs territory of the Community, provided that the goods are used by an authority in charge of law enforcement in both the country or territory of destination and the metropolitan part of the Member State to which that territory belongs.
2. Le paragraphe 1 ne s’applique pas aux exportations vers les territoires des États membres qui sont énumérés dans l’annexe IV mais ne font pas partie du territoire douanier de la Communauté, pourvu que les biens concernés soient utilisés par une autorité chargée de faire respecter la loi à la fois dans le pays ou territoire de destination et dans le territoire métropolitain de l’État membre auquel ce territoire est rattaché.
