3. Notwithstanding the provisions of paragraph 2, subparagraph (a), as long as according to the laws of Iceland dividends paid by a company which is a resident of Iceland may be deducted from the taxable profits or may be carried forward as an operating loss of such company for income tax purposes, dividends paid by such company to a resident of Canada may also be taxed in Iceland and according to the laws of Iceland, but if the beneficial owner of the dividends is a resident of Canada, the tax so charged shall not exceed 15 per cent, on such part of the dividends which is deductible from the company’s taxable profits or can be carried forward as an operating loss of the company.

(b) the term “Iceland” means the Republic of Iceland and, when used in a geographical sense, means the territory of the Republic of Iceland, including its territorial sea, and any area beyond the territorial sea within which Iceland, in accordance with international law, exercises jurisdiction or sovereign rights with respect to the seabed, its subsoil and its superjacent waters, and their natural resources;

As regards an invalidity pension or widow’s pension, in determining the period of domicile of a person who lives outside the territory of Iceland and who was not in receipt of the pension in question when leaving Iceland, the period until reaching the age of 67 shall be taken into account only in the proportion which the periods of domicile in Iceland after reaching the age of 16 bear in relation to the total of those periods and periods of residence in Canada which are creditable for purposes of the Old Age Security Act of Canada.

The Council recalled that the negotiations are aimed at Iceland fully adopting and applying the EU acquis. The course of the negotiations will be determined by whether Iceland meets all of its obligations under the EEA Agreement, taking full account, among other things, of the European Council conclusions of 17 June 2010, and also by the results it achieves in eliminating other deficiencies identified in the Commission’s opinion.

Let me also briefly mention the support measures we are putting in place under the Instrument for Pre-Accession Assistance (IPA). There is provision for a total indicative envelope of EUR 28 million for the next three years to support strengthening of administrative capacity and to prepare Iceland for management of the structural funds.

With regard to the geopolitical picture, this will change considerably if Iceland’s EU accession negotiations prove successful. Iceland’s accession would also strengthen the EU’s presence in the region.
