IN-CONTEXT TRANSLATIONS

If it is concluded, on the basis of a risk assessment, that the plant, plant product or other object originating in the third country, group of third countries or specific area of the third country concerned referred to in paragraph 2 poses an unacceptable risk, but that that risk can be reduced to an acceptable level by applying one or more of the measures set out in points 2 and 3 of Section 1 of Annex II, the Commission shall adopt an implementing act removing that plant, plant product or other object and the third country, group of third countries or specific area of the third country concerned from the list referred to in paragraph 2 and add it to the list referred to in Article 41.

In order to ensure uniform conditions for the implementation of this Regulation implementing powers should be conferred on the Commission with respect to: listing the plants, plant products and other objects which are prohibited from being introduced into the Union territory, and the third countries concerned; listing the plants, plant products and other objects subject to special requirements, and the special requirements concerned for their introduction into, and movement within, the Union territory; the provisional listing of the high-risk plants, plant products and other objects whose introduction into the Union territory is to be prohibited, and the third countries concerned; the procedure for risk assessment in connection with that listing; setting out, for third countries, requirements that are equivalent to the requirements for movement within the Union territory of plants, plant products or other objects; setting out arrangements for the presentation and use of posters and brochures concerning the introduction of plants, plant products and other objects into the Union territory; setting out specific conditions or measures concerning the introduction of particular plants, plant products and other objects into frontier zones of Member States; adoption of temporary measures concerning plants, plants products and other objects likely to pose newly identified pest risks or other suspected phytosanitary risks; adopting decisions on temporary measures taken by Member States concerning imminent danger; listing of plants, plant products and other objects which are prohibited from being introduced into certain protected zones; listing the plants, plant products and other objects subject to special requirements, and the special requirements concerned for their introduction into, and movement within, certain protected zones; and laying down rules concerning the requirements for quarantine stations and confinement facilities, and the release of plants, plant ...
Afin d'assurer des conditions uniformes d'exécution du présent règlement, il convient de conférer des compétences d'exécution à la Commission pour dresser la liste des végétaux, produits végétaux et autres objets dont l'introduction sur le territoire de l'Union est interdite, et énumérant les pays tiers concernés; dresser la liste des végétaux, produits végétaux et autres objets faisant l'objet d'exigences particulières, et établir les exigences particulières applicables à leur introduction et à leur circulation sur le territoire de l'Union; dresser la liste provisoire des végétaux, produits végétaux et autres objets à haut risque dont l'introduction sur le territoire de l'Union doit être interdite, et énumérant les pays tiers concernés; définir la procédure d'évaluation des risques en rapport avec cette liste; établir, pour les pays tiers, des exigences équivalentes à celles applicables à la circulation des végétaux, produits végétaux ou autres objets sur le territoire de l'Union; définir les modalités de présentation et d'utilisation des affiches et des brochures concernant l'introduction de végétaux, produits végétaux et autres objets sur le territoire de l'Union; établir des conditions ou mesures particulières concernant l'introduction de certains végétaux, produits végétaux et autres objets dans les zones frontalières des États membres; adopter des mesures provisoires concernant des végétaux, produits végétaux et autres objets susceptibles de présenter des risques phytosanitaires nouvellement identifiés ou d'autres risques phytosanitaires soupçonnés; adopter des décisions relatives aux mesures provisoires prises par les États membres concernant un danger imminent; dresser la liste des végétaux, produits végétaux et autres objets dont l'introduction dans certaines zones protégées est interdite; dresser la liste des végétaux, produits végétaux et autres objets faisant l'objet d'exigences particulières, et établir les exigences particulières applicables ...

4. If it is concluded, on the basis of a risk assessment, that the plant, plant product or other object originating in the third country, group of third countries or specific area of the third country concerned referred to in paragraph 2, on the taxonomic level as listed in the implementing act provided for in paragraph 3 or below that level, does not pose a risk of an unacceptable level by its likelihood to host a Union quarantine pest, the Commission shall adopt an implementing act removing that plant, plant product or other object from the list referred to in that paragraph for the third countries concerned.
4. S'il ressort d'une évaluation des risques que le végétal, produit végétal ou autre objet, originaire du pays tiers, groupe de pays tiers ou zone spécifique du pays tiers concerné, visé au paragraphe 2, de niveau taxinomique tel qu'établi dans l'acte d'exécution prévu au paragraphe 3, ou d'un niveau inférieur, ne présente pas un risque inacceptable parce qu'il est susceptible de porter un organisme de quarantaine de l'Union, la Commission adopte un acte d'exécution pour retirer ce végétal, produits végétal ou autre objet de la liste visée dans ce paragraphe pour les pays tiers concernés.

If it is concluded, on the basis of a risk assessment, that the plant, plant product or other object originating in the third country, group of third countries or specific area of the third country concerned referred to in paragraph 2 poses an unacceptable risk due to the likelihood that it hosts a Union quarantine pest, and that that pest risk cannot be reduced to an acceptable level by applying one or more of the measures set out in points 2 and 3 of Section 1 of Annex II, the Commission shall adopt an implementing act removing that plant, plant product or other object and the third countries concerned from the list referred to in paragraph 2 and add it to the list referred to in Article 40.

In order to ensure uniform conditions for the implementation of this Regulation implementing powers should be conferred on the Commission with respect to: listing of the plants, plant products and other objects, and the respective third countries of origin or dispatch, for which a phytosanitary certificate is to be required for their introduction into the Union territory; listing of the plants, plant products and other objects, and the respective third countries of origin or dispatch, for which a phytosanitary certificate is to be required for their introduction into certain protected zones from those third countries; listing of the plants, plant products and other objects, the third countries concerned, and the maximum quantity subject to be exempted from the requirement for a phytosanitary certificate when introduced in the Union territory; and setting out technical arrangements concerning the invalidation of the electronic phytosanitary certificates.

If there is no Community interest and if there is no agreement with the third country concerned, the Commission shall in making its assessment check whether any relevant Community agreement with the third country concerned is specifically envisaged within the following two years. If this is not the case, the Commission shall check that the following four conditions are met:
