Where the transfer of enforcement of a custodial penalty is accepted, the competent authorities in the administering State must either enforce the penalty imposed in the sentencing State - immediately or through an order - or through a judicial or administrative procedure convert the sentence into a decision of the administering State, thereby substituting the penalty imposed in the sentencing State by a penalty laid down by the law of the administering State for the same offence (Article 8).
Lorsque la transmission de l'exécution d'une condamnation à une peine privative de liberté a été acceptée, les autorités compétentes de l'État d'exécution doivent soit exécuter la peine infligée dans l'État de condamnation - immédiatement ou sur la base d'une décision -, soit convertir la condamnation, par une procédure judiciaire ou administrative, en une décision de cet État, substituant ainsi à la peine infligée dans l'État de condamnation une peine prévue par la législation de l'État d'exécution pour la même infraction (art. 8).
