Is pleased with the achievements in the area of translation following the renewed EESC-Committee Cooperation agreement; notes, however, that a high demand for translation during peak periods resulted in an increase for outsourcing resources; calls on the Committee to set a better timetable for translation demands;

Therefore, during a transitional period, a request for unitary effect as referred to in Article 12 of Regulation xx/xx implementing enhanced cooperation in the area of the creation of unitary patent protection shall be accompanied by the following: (i) a full translation of the specification of such patent into English where the language of the proceedings before the EPO in accordance with Article 14(3) of the EPC is French or German; or (ii) a full translation of the specification of such patent into any official language of the participating Member States that is an official language of the Union where the language of the proceedings before the EPO is English.

The EPO shall administer requests for unitary effect, include and administer in the European Patent Register entries relating to European patents with unitary effect, receive and register statements on licensing, ensure the publication of the translations required during the transitional period, collect and administer the renewal fees (as well as additional fees), the distribution of a part of the collected renewal fees to the participating Member States and administer a compensation scheme of translation costs for applicants filing European patent applications in one of the official languages of the Union that is not an official language of the EPO.

(11) During a transitional period, before a system of high quality machine translations into all official languages of the Union becomes available, a request for unitary effect as referred to in Article 12 of Regulation xx/xx [substantive provisions] shall be accompanied by a full translation of the specification of the patent into English where the language of the proceedings before the European Patent Office is French or German, or into any official language of the participating Member States that is an official language of the Union where the language of the proceedings before the European Patent Office is English.

(15) The participating Member States should give the European Patent Office certain administrative tasks relating to European patents with unitary effect, in particular as regards administration of requests for unitary effect, the registration of unitary effect and of any limitation, licence, transfer, revocation or lapse of European patents with unitary effect, the collection and redistribution of renewal fees, the publication of translations for information purposes during a transitional period and the administration of a compensation scheme of translation costs for applicants filing European patent applications in a language other than one of the official languages of the European Patent Office.
(15) Les États membres participants devraient confier à l'Office européen des brevets certaines tâches administratives dans le domaine des brevets européens à effet unitaire, notamment la gestion des demandes d'effet unitaire, l'enregistrement de l'effet unitaire et de toute décision de limitation, licence, transfert, révocation ou extinction des brevets européens à effet unitaire, la collecte et la redistribution des taxes annuelles, la publication de traductions purement informatives durant une période de transition et la gestion d'un système de compensation des coûts de traduction pour les demandeurs qui déposent leur demande de brevet européen dans une langue autre que l'une des langues officielles de l'Office européen des brevets.

Acknowledges from the Centre's AAR that during the financial year 2010 around 55 % of the total volume of pages translated was outsourced; notes from its AAR that the Centre took steps to consolidate the management of its translation workflow in 2010 by merging the Demand Management and Freelance Management Sections; acknowledges, in particular, that an external study on validation of the ratio between works carried out internally and outsourcing has been completed and that the calculation model used by the Centre was validated;

Invites the Bureau and Committee on Budgets to urgently address the Inter-Institutional Working Group on multilingualism in order to prepare a proposal (technical level) in order to make sure that inter-institutional cooperation in this field, especially as concerns the use of any free capacity, is improved; is disappointed, for instance, that the system in place for better sharing of translation between institutions is hardly used at all; expects to see a proposal on where possibilities for improvement exist before the first reading; also takes a keen interest in new technical tools for its translation services and asks for information on their development and the related financial consequences during 2010, including the study of the Euramis translation tool; would welcome, in this study, an assessment of whether this tool could lead to improved interinstitutional cooperation in the field of translation, and also efficiency gains and cost savings that could reduce dependence on external translation services;
