In this context it should be emphasised that, despite the substantively identical proceedings which are now under way on appeal, a fresh decision on whether to waive the immunity of Viktor Uspaskich is required because the European Parliament strictly observes the provisions of the national Constitution, which requires such a decision on procedural grounds before the national authorities can continue their procedure.
