Union procedures to ensure the effective exercise of the rights of the Union under international trade rules should be based on a legal mechanism under Union law which is fully transparent, and ensures that the decision to invoke the Union’s rights under international trade rules is taken on the basis of accurate factual information and legal analysis.

The Instrument should be implemented in full compliance with the rights and principles enshrined in the Charter of Fundamental Rights of the European Union and with the Union’s international obligations, and without prejudice to the application of special provisions concerning the right to asylum and to international protection.

Further amendments to that Regulation were introduced by Regulation (EC) No 648/2005 of the European Parliament and of the Council of 13 April 2005 (6) - and subsequently included in Regulation (EC) No 450/2008 - as a consequence of the important legal changes which have occurred in recent years, at both Union and international level, such as the expiry of the Treaty establishing the European Coal and Steel Community and the entry into force of the 2003, 2005 and 2011 Acts of Accession, as well as the amendment to the International Convention on the simplification and harmonisation of customs procedures (the Revised Kyoto Convention), the Union's accession to which was approved by Council Decision 2003/231/EC of 17 March 2003 (7).

Urges the Council and the Commission to continue the practice of demarches in respect of all of the European Union's international partners as regards the ratification and implementation of international conventions banning the use of torture and ill-treatment, as well as the provision of rehabilitation assistance to torture survivors; calls on the European Union to regard the fight against torture and ill-treatment as a top priority of its human rights policy, in particular through enhanced implementation of the European Union guidelines and all other European Union instruments such as the EIDHR and by ensuring that Member States refrain from accepting diplomatic assurances from third countries where there is a real risk of people being subjected to torture or ill-treatment;
prie instamment le Conseil et la Commission de poursuivre la pratique des démarches auprès de tous les partenaires internationaux de l'Union en vue de la ratification des conventions internationales proscrivant le recours à la torture et aux mauvais traitements, de leur mise en œuvre ainsi que de la mise à disposition d'une assistance pour la réhabilitation des personnes ayant survécu à la torture; demande à l'Union d'inscrire la lutte contre la torture et les mauvais traitements parmi les priorités de sa politique des Droits de l'homme, notamment en promouvant une application plus rigoureuse des lignes directrices de l'Union et de tous les autres instruments de l'Union, comme l'IEDDH, ainsi qu'en veillant à ce que les États membres n'acceptent pas les assurances diplomatiques de pays tiers dans lesquels existe un risque réel d'être soumis à la torture ou aux mauvais traitements.
