The regulation reserves to the Commission the facility of laying down the definition of the Community objectives: it may even publish that definition beforehand in the Official Journal. This amounts to creating discretionary powers of an unjustifiable reach, thanks to which the Commission could end up encroaching on the legislative terrain of other bodies, thus affecting the possibilities of promoting actions related to technological development.
D'autre part, il convient d'appeler l'attention sur le surcroît de pouvoir réglementaire qui reviendrait désormais à la Commission dans la mesure où, aux termes du règlement, elle serait habilitée à élaborer la définition des objectifs communautaires et même à la publier au préalable au Journal officiel; ces pouvoirs discrétionnaires injustifiés lui permettraient alors d'empiéter sur le terrain législatif, qui appartient à d'autres institutions, ce qui ne manquerait pas d'amoindrir les possibilités de promotion des actions dans le domaine du développement technologique.
