The Commission has therefore declared itself in favour of devolving on the CFI the jurisdiction proposed by the Court of Justice - staff cases, competition cases, cases on steel quotas and ECSC levies - with the exception of trade protection (anti- dumping and anti-subsidy) cases. As regards the latter the Commission takes the view that the present decision-making procedure - whereby the Commission takes only provisional decisions that have to be subsequently confirmed by the Council -is too cumbrous to leave room for the addition of a review by two tiers of courts (CFI and Court of Justice) The Commission also considers that the forms of jurisdiction proposed for the CFI presuppose that it consists of two sections, one specializing in the law governing the public service and the other in economic law.

Mr. Len Stewart: There's dumping and there's actually subsidy, and in the original anti-dumping investigation carried out by the U.S. Department of Commerce, in 1997 or 1998, they found the actual subsidy to be de minimis, to be below a rate whereby they would apply a duty based on it.
