Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. The third character of the code identifies the substance involved, and the fourth character specifies the clinical state. The codes should be used, as required, for each substance specified, but it should be noted that not all fourth character codes are applicable to all substances. Identification of the psychoactive substance should be based on as many sources of information as possible. These include self-report data, analysis of blood and other body fluids, characteristic physical and psychological symptoms, clinical signs and behaviour, and other evidence such as a drug being in the patient's possession or reports from informed third parties. Definition: A form of tic disorder in which there are, or have been, multiple motor tics and one or more vocal tics, although these need not have occurred concurrently. For the purposes of the present appeal, it must first be stated that the Civil Service Tribunal recalled that any decision relating to a specific individual which is taken under the Staff Regulations and adversely affects that person must state the reasons on which it is based, on the one hand, to enable the competent court to review the legality of the decision and, on the other, to provide the person concerned with the information necessary to allow him to ascertain whether or not the decision is well founded and to enable him to decide whether to bring an action. It added, however, referring to Case C‑254/95 P Parliament v Innamorati [1996] ECR I‑3423, paragraphs 24 to 28, that, as far as concerns decisions taken by a selection board in a competition, the obligation to state reasons must be reconciled with observance of the secrecy surrounding the proceedings of selection boards by virtue of Article 6 of Annex III to the Staff Regulations, secrecy which was instituted with a view to guaranteeing the independence of selection boards and the objectivity of their proceedings. Thus, observance of this secrecy precludes both disclosure of the attitudes adopted by individual members of selection boards and disclosure of any factors relating to individual or comparative assessments of candidates and that the obligation to state the reasons on which decisions of a selection board in a competition are based must take account of the nature of the proceedings concerned, which, at the stage of examination of the abilities of the candidates, are primarily comparative in character and accordingly covered by the secrecy inherent in those proceedings (paragraphs 30 and 31 of the judgment under appeal).
Aux fins du présent pourvoi, en premier lieu, il convient de relever que le Tribunal de la fonction publique a rappelé que toute décision individuelle prise en application du statut et faisant grief doit être motivée, et que l’obligation de motivation a pour objet, d’une part, de permettre au juge d’exercer son contrôle sur la légalité de la décision et, d’autre part, de fournir à l’intéressé les indications nécessaires pour savoir si la décision est ou non fondée et lui permettre d’apprécier l’opportunité de l’introduction d’un recours. Il a néanmoins ajouté, en faisant référence à l’arrêt de la Cour du 4 juillet 1996, Parlement/Innamorati (C‑254/95 P, Rec. p. I‑3423, points 24 à 28), que, en ce qui concerne les décisions prises par un jury de concours, l’obligation de motivation doit être conciliée avec le respect du secret qui entoure les travaux du jury en vertu de l’article 6 de l’annexe III du statut, secret institué en vue de garantir l’indépendance des jurys de concours et l’objectivité de leurs travaux. Ainsi, le respect de ce secret s’oppose à la divulgation tant des attitudes prises par les membres individuels des jurys que de tous éléments ayant trait à des appréciations de caractère personnel ou comparatif concernant les candidats, et l’exigence de motivation des décisions d’un jury de concours doit tenir compte de la nature des travaux en cause, lesquels, au stade de l’examen des aptitudes des candidats, sont avant tout de nature comparative et, de ce fait, couverts par le secret inhérent à ces travaux (points 30 et 31 de l’arrêt attaqué).

I therefore wish to highlight an extremely positive aspect of the Commission proposal, which is the complementarity of the dual status of international protection in which, in addition to the narrow approaches of the 1950s, the concept is extended to subsidiary protection, clarifying the concept of the perpetrators of persecution not limited solely to the State and its agents but also to material circumstances and others in which the outcome is that the State does not give protection, either because it cannot or because it does not want to, and we can all recall such situations in Africa and in Latin America. We also have the concept’s inclusion of the protection organisations of stable quasi-State authorities, which must be held responsible in practical terms for the protection of individuals who fall outside the scope of simple peace or military security missions, which often relegate into second place the effective protection of individuals and respect for human rights. Lastly, extending refugees’ rights in terms of periods of residence, employment and integration mechanisms, which concern every aspect of refugees’ citizenship.
C’est pourquoi il est très positif que la proposition de la Commission prévoie la complémentarité du double statut de protection internationale qui, au-delà des conceptions étroites des années 50, étend le concept à la protection subsidiaire ; la clarification du concept d’agent de persécution non lié étroitement à l’État et à ses agents, mais aussi aux circonstances matérielles et autres qui font que l’État n’offre pas de protection soit parce qu’il ne peut pas soit parce qu’il ne veut pas (nous nous souvenons tous de l’Afrique et de l’Amérique latine) ; l’inclusion dans le concept d’institutions de protection des autorités permanentes s'apparentant à un État (il s’agit de les investir de responsabilités concrètes dans la protection des individus qui dépassent les routines de la simple mission de paix et de la sécurité militaire, qui renvoient souvent au second plan la protection effective des individus et le respect des droits de l’homme) ; et, finalement, l'extension des droits des réfugiés quant aux délais de séjour, à l’emploi et aux mécanismes d’intégration, qui concernent tous les aspects de la citoyenneté du réfugié.
