My suggestion was that rather than adding sexual orientation to the list in section 318, which deals, if I read it correctly, with the incitement of crimes which would lead to acts of genocide, that section 319, which deals with incitement of hatred which would lead to breaches of the peace — which could include any number of things, could more effectively — in respect of the likelihood of the success of prosecution, which would then be absent the onus of genocide, be achieved by restating the list of identifiable groups.
