In order to supplement or amend certain non-essential elements of this Regulation, the power to adopt acts in accordance with Article 290 of the TFEU should be delegated to the Commission in respect of the establishment of production processes for obtaining aromatised wine products; criteria for the demarcation of geographical areas and rules, restrictions and derogations related to production in such areas; the conditions under which a product specification may include additional requirements; the determination of the cases in which a single producer may apply for the protection of a geographical indication and the restrictions governing the type of applicant that may apply for such protection; the establishment of the conditions to be complied with in respect of an application for the protection of a geographical indication, scrutiny by the Commission, the objection procedure and procedures for amendment and cancellation of geographical indications; the establishment of the conditions applicable to trans-border applications; the setting of the date for the submission of an application or a request, the date from which the protection applies and the date on which an amendment to a protection applies; the establishment of the conditions relating to amendments to product specifications, including the conditions when an amendment is considered minor and the conditions relating to the applications for, and approval of, amendments, which do not involve any change to the single document; the restrictions regarding the protected name; the nature and type of information to be notified in the exchange of information between Member States and the Commission, the methods of notification, the rules related to the access rights to information or information systems made available and the modalities of publication of the information.

There is no EU legislation on the aquaculture sector at present, and it continues to be covered by a plethora of EU legislation and national rules which can vary significantly between states, creating a legal framework lacking in transparency and discriminatory situations and market distortions that do little to encourage investment in the sector. The Commission adopted an initial communication in 2002, which was the subject of a European Parliament legislative resolution of January 2003, has failed to increase the transparency of the regulatory framework. On the contrary, the Commission and Council have continued to adopt, often via the comitology procedure, detailed rules applicable to aquaculture (organic and otherwise), in respect of which Parliament has had no opportunity whatsoever to voice a direct opinion. The recent Commission communication of April 2009 which forms the subject of this report therefore provides the chance to assess the appropriateness of introducing a specific EU framework for the aquaculture sector, with the ultimate objective remaining the structured development of a sustainable European aquaculture industry which respects environmental balances, increases the economic worth of aquaculture operators and their local communities and offers consumers more guarantees.

The CFI, by failing to order the disclosure of the evidence requested, has infringed the fundamental right to a fair trial to which the applicant is entitled, by refusing to assess evidence which is essential to the applicant's case thereby infringing its rights of defence, since its application was dismissed on the ground that it had not proved what it specifically sought to establish with the evidence which was not produced: if not the Commission's final position with respect to the complaint of 1994 against the tax rules of 1993 (including a tax credit), which are measures which are essentially the same as the contested measure, which rejected that complaint, then at least the attitude of the Commission which would constitute an exceptional circumstance in so far as its conduct gave rise to a legitimate expectation that the 1993 tax measures were lawful, which led to the adoption of the contested tax measure in 1996.

I therefore wish to highlight an extremely positive aspect of the Commission proposal, which is the complementarity of the dual status of international protection in which, in addition to the narrow approaches of the 1950s, the concept is extended to subsidiary protection, clarifying the concept of the perpetrators of persecution not limited solely to the State and its agents but also to material circumstances and others in which the outcome is that the State does not give protection, either because it cannot or because it does not want to, and we can all recall such situations in Africa and in Latin America. We also have the concept’s inclusion of the protection organisations of stable quasi-State authorities, which must be held responsible in practical terms for the protection of individuals who fall outside the scope of simple peace or military security missions, which often relegate into second place the effective protection of individuals and respect for human rights. Lastly, extending refugees’ rights in terms of periods of residence, employment and integration mechanisms, which concern every aspect of refugees’ citizenship.

The first instrument referred to springs from the Commission's own role as the guardian of the Treaties, which enables it to bring infringement proceedings against the Member States before the Court of Justice in respect of those fiscal measures which prevent the internal market functioning smoothly. The second group of instruments indicated by the Commission comprises non-legislative instruments based on measures which are non-binding, but on which it is possible to develop a strong political consensus (soft legislation).

I can now confirm something which has already appeared in the White Paper on reform of the Commission, specifically in action 29 which is about improving transparency in a way which benefits candidates and in which it is stated that ‘Finally, pursuant to the European Ombudsman’s recommendation, the Commission will allow candidates access to their corrected tests in all competitions launched after July 2002’.

The Commission suggests that during the year 2001 Member States and the Commission should together define what work should be undertaken in each of the areas concerned - which are suitable for peer review or the exchange of good practice, where progress should be compared against which benchmarks, which areas need indicators, where new indicators should be defined, the way in which Member States will take a view about developments likely to be positive in the future. At the same time, consideration will need to be given to the way in which education and training are represented within (say) the Luxembourg process, or the Commission's annual Synthesis Report; just as continuing activity at EU level, such as the debate on the Memorandum on Lifelong Learning, will surely provide very valuable contributions to the discussions.

The Commission cannot accept the following amendments of substance: Amendment No 5 to help Member States distinguish between national – for example non-EU derived – law and EU law. Amendments Nos 6 and 11 which try to change voluntary reporting and advice schemes to mandatory ones. Amendment No 12, second part, because it does not add anything. The proposal already refers to reports being in a readily accessible database. Amendment No 13, second part, relating to reports of site visits being available within two months of inspection because the common position's wording “as soon as possible” is preferable. And Amendment No 14 which seeks to limit to brief data the compliance information in reports to the Commission, which is not sufficient for the Commission's purposes.

(8) Whereas the Commission has implemented a European programme on air quality, road traffic emissions, fuels and engines technologies (the Auto/Oil Programme) with a view to fulfilling the requirements of Article 4 of Directive 94/12/EC; whereas the Commission has implemented the APHEA Project which estimates the external costs of air pollution by motor vehicles at 0,4 % of EU GNP, and further assessments conclude that the external costs amount to 3 % of EU GNP, whereas the Commission has implemented the 'Car of Tomorrow` Action Plan which strives to contribute to the promotion of the 'Car of Tomorrow` which will be clean, safe, energy efficient and 'intelligent`; whereas this action plan enforces Community action promoting R D leading to clean cars and whereas neither the R D efforts undertaken in the framework of the 'Car of Tomorrow` Action Plan nor EU competitiveness in automobile R D should be jeopardised; whereas the European motor vehicle and oil industries have carried out the European Programme on Emissions, fuels and Engine Technologies (EPEFE) to determine the contribution which can be made both by future vehicles and the fuels which propel them; whereas the Auto/Oil and EPEFE programmes strive to ensure that proposals for Directives on polluting emissions seek the best solutions for both the citizen and for the economy; whereas the need for Community action for the forthcoming Steps 2000 and 2005 has become urgent; whereas it has become apparent that a further improvement of car emission technology is necessary with a view to achieving air quality in the year 2010 as described in the Commission communication on the Auto/Oil Programme;
