There is no EU legislation on the aquaculture sector at present, and it continues to be covered by a plethora of EU legislation and national rules which can vary significantly between states, creating a legal framework lacking in transparency and discriminatory situations and market distortions that do little to encourage investment in the sector. The Commission adopted an initial communication in 2002, which was the subject of a European Parliament legislative resolution of January 2003, has failed to increase the transparency of the regulatory framework. On the contrary, the Commission and Council have continued to adopt, often via the comitology procedure, detailed rules applicable to aquaculture (organic and otherwise), in respect of which Parliament has had no opportunity whatsoever to voice a direct opinion. The recent Commission communication of April 2009 which forms the subject of this report therefore provides the chance to assess the appropriateness of introducing a specific EU framework for the aquaculture sector, with the ultimate objective remaining the structured development of a sustainable European aquaculture industry which respects environmental balances, increases the economic worth of aquaculture operators and their local communities and offers consumers more guarantees.

However, it is also out of the very limited budget for this instrument that the election observation missions are financed. These are crucial missions which, in the space of around 10 years, have succeeded in proving their worth, but for which Parliament has already requested more resources and certainly more follow-up action – thank you, Mrs Malmström – but also more political consistency in terms of the way in which we monitor their legitimacy, and here I fully support what Mrs Joly said regarding some of our missions.

In order to improve the reliability of such lists, appropriate verification and/or correction mechanisms and minimum guarantees for the persons concerned should be established, at least at the initiative of the Member States of the Sanctions Committees which are also members of the EU. It is very positive to note that our Parliament accepts by an overwhelming majority firstly, that any renationalisation of regional policy would be devastating even to the very existence of the European Union, of which it is a basic connective fabric, secondly, that the so-called statistical effect of enlargement – of any enlargement – would be addressed in such a way as to ensure continuing support for the regions for which it was considered necessary before enlargement, in order not to interrupt their progress towards development, thirdly, that the special regions from the point of view of natural disadvantages will also need to receive special treatment and finally, that the cohesion policy, which is indeed an essential tool to enable the Union to achieve the Lisbon objectives, has provided important results to date. It is therefore worth our while to continue this balanced, balancing, reliable and effective policy.

Thirdly, it is worth bearing in mind the debate, which has already begun, on how to improve the highly praiseworthy work of the various committees of independent experts, the so-called ‘Treaty bodies’, which monitor and oversee proper compliance with many of the conventions to which I referred a moment ago.
