b) "accord de transfert de technologie", un accord de licence de brevet, un accord de licence de savoir-faire, un accord de licence de droits d'auteur sur logiciels ou un accord mixte de licence de brevet, de savoir-faire ou de droits d'auteur sur logiciels, y compris tout accord de ce type contenant des dispositions relatives à la vente et à l'achat de produits ou à la concession d'une licence pour d'autres droits de propriété intellectuelle ou à la cession de droits de propriété intellectuelle, à condition que ces dispositions ne constituent pas l'objet principal de l'accord et qu'elles soient directement liées à la production des produits contractuels. Les cessions de brevets, de savoir-faire, de droits d'auteur sur logiciels ou d'une combinaison de ces éléments, sous réserve qu'une partie du risque lié à l'exploitation de la technologie soit supportée par le cédant, notamment lorsque le montant dû au titre de la cession dépend du chiffre d'affaires réalisé par le cessionnaire avec les produits qui sont produits à l'aide de la technologie cédée, de la quantité de produits fabriquée ou du nombre d'opérations réalisées à l'aide de la technologie concernée, sont également considérées comme des accords de transfert de technologie;

In the event that, pending the completion of the procedures necessary for the entry into force of this Agreement, the provisions of certain parts of this Agreement, in particular those relating to the free movement of goods, are put into effect by means of an Interim Agreement between the Community and Lebanon, the parties agree that, in such circumstances, for the purposes of Titles II and IV of this Agreement and Annexes 1 and 2 and Protocols 1 to 5 thereto, the terms ‘date of entry into force of this Agreement’ mean the date of entry into force of the Interim Agreement in relation to obligations contained in these Articles, Annexes and Protocols.
Si, en attendant l'accomplissement des procédures nécessaires à l'entrée en vigueur du présent accord, les dispositions de certaines parties de l'accord, notamment celles relatives à la libre circulation des marchandises, sont mises en application par un accord intérimaire entre la Communauté et le Liban, les parties conviennent que, dans ces circonstances et aux fins des titres II et IV du présent accord, des annexes 1 et 2 et des protocoles nos 1 à 5, on entend par «date d'entrée en vigueur du présent accord» la date d'entrée en vigueur de l'accord intérimaire pour ce qui est des obligations contenues dans lesdits articles, annexes et protocoles.

(10) Whereas the powers conferred on the Commission by Regulation No 19/65/EEC do not allow it to conduct a reform of the rules currently in force which would cover all types of vertical agreements; whereas the scope of Article 1(1)(a) and (2)(b) thereof should consequently be broadened to cover all agreements caught by Article 81(1) of the Treaty which are entered into by two or more undertakings, each operating, for the purposes of the agreement, at a different level of the production or distribution chain and which relate to the conditions under which the parties may purchase, sell or resell certain goods or services (vertical agreements), including exclusive distribution agreements, exclusive purchasing agreements, franchising agreements and selective distribution agreements, or any combination of these, and certain non-reciprocal vertical agreements entered into between competing undertakings, as well as vertical agreements between an association of small and medium-sized retailers and its members or between such an association and its suppliers;
(10) considérant que les pouvoirs conférés à la Commission par le règlement n° 19/65/CEE ne permettent pas à celle-ci de procéder à une réforme des règles actuellement en vigueur, qui porterait sur tous les types d'accords verticaux; qu'il faut, par conséquent, élargir la portée de l'article 1er, paragraphe 1, point a), et paragraphe 2, point b), dudit règlement afin de couvrir tous les accords visés par l'article 81, paragraphe 1, du traité qui sont conclus entre deux ou plus de deux entreprises dont chacune opère, aux fins de l'accord, à un niveau différent de la chaîne de production ou de distribution et qui concernent les conditions dans lesquelles les parties à l'accord peuvent acquérir, vendre ou revendre certains biens ou services ("accords verticaux"), y compris les accords de distribution exclusive, d'achat exclusif, de franchise et de distribution sélective, ainsi que leurs combinaisons, et certains accords verticaux non réciproques qui sont conclus entre des entreprises concurrentes, ainsi que des accords verticaux conclus entre une association de petits et moyens détaillants et ses membres ou entre une telle association et ses fournisseurs;
