The main change to the anti-dumping legislation is the introduction of a new way to calculate dumping in anti-dumping investigations on imports from members of the World Trade Organization (WTO) in case prices and costs are distorted because of state intervention.
La principale innovation apportée aux règles antidumping est l'établissement d'un nouveau mode de calcul de la marge de dumping dans les enquêtes portant sur des importations en provenance de pays membres de l'Organisation mondiale du commerce (OMC) lorsque les prix et les coûts sont faussés en raison de l'intervention de l'État.

The Agreement on Implementation of Article VI of the General Agreement on Tariffs and Trade 1994 (‘the 1994 Anti-Dumping Agreement’) contains detailed rules, relating in particular to the calculation of dumping, procedures for initiating and pursuing an investigation, including the establishment and treatment of the facts, the imposition of provisional measures, the imposition and collection of anti-dumping duties, the duration and review of anti-dumping measures and the public disclosure of information relating to anti-dumping investigations.
L'accord sur la mise en œuvre de l'article VI de l'accord général sur les tarifs douaniers et le commerce de 1994 (ci-après dénommé «accord antidumping de 1994») contient des règles détaillées, concernant en particulier le calcul de la marge de dumping, les procédures d'ouverture et de déroulement d'une enquête, y compris l'établissement et le traitement des faits, l'institution de mesures provisoires, l'imposition et la perception de droits antidumping, la durée et le réexamen des mesures antidumping et la divulgation des informations relatives aux enquêtes antidumping.

However, as explained in recital 22, there is an increasing presence of Indian producers at the doorstep of the Union market, by way of export sales to the Union ports not being subject to customs clearance and thus free of the said anti-dumping duties.

Pursuant to Article 2(7)(b) of the basic Regulation, in anti-dumping investigations concerning imports originating in the PRC normal value shall be determined in accordance with paragraphs 1 to 6 of the said Article for those exporting producers which have shown that they meet the criteria laid down in Article 2(7)(c) of the basic Regulation, i.e. where it is demonstrated by such exporting producers that market economy conditions prevail in respect of the manufacture and sale of the like product.

(10) The Council and the Commission may consider it appropriate to amend, suspend or repeal anti-dumping and/or anti-subsidy measures or to provide for exemptions in whole or in part from any anti-dumping or countervailing duties which would otherwise be payable, or to adopt any other special measures.
