TRADUCTIONS EN CONTEXTE

The Protocol foresees that MS authorities should provide details of bank accounts and banking operations of identified persons and may not rely on banking secrecy rules as a ground for refusing to co-operate in this context.
In dit protocol is vastgelegd dat de autoriteiten van de lidstaten gegevens over bankrekeningen en banktransacties van geïdentificeerde personen moeten verstrekken en dat zij zich niet op hun bankgeheim mogen beroepen om samenwerking in dit kader te weigeren.

National rules on banking secrecy could hamper the efficiency of the mechanisms provided for in this Regulation.

Recalls in this context that it is of primary importance to put an end to the use of artificial legal persons as a way to avoid taxation; stresses also that instead of bank secrecy, automatic information exchange should take place in all circumstances, including in all the Member States and dependent territories; welcomes in this respect the Commission's proposal on administrative cooperation in the field of taxation because, inter alia, it extends cooperation between the Member States to cover taxes of any kind, abolishes bank secrecy and establishes the automatic exchange of information as a general rule;
3. herinnert er in dit verband aan dat het van elementair belang is een einde te maken aan het gebruik van kunstmatige rechtspersonen als middel om belastingen te ontwijken; dringt er daarnaast op aan dat in plaats van het bankgeheim in alle omstandigheden automatische informatie-uitwisseling plaatsvindt, ook in alle lidstaten en de daarvan afhankelijke gebieden; is in dit verband tevreden met het Commissievoorstel inzake administratieve samenwerking op belastinggebied, onder andere omdat de samenwerking tussen de lidstaten ermee wordt uitgebreid naar welk type belastingen ook, het bankgeheim ermee wordt afgeschaft en automatische uitwisseling van informatie ermee wordt ingesteld als algemene regel;

In particular, regrets that the G20 did not confirm the end of banking secrecy, which is used as a shield for tax evaders; stresses also that instead of banking secrecy, automatic information exchanges should occur in all circumstances, including between all EU countries and dependent territories; supports the Commission proposal to introduce automatic information exchange as a rule for administrative cooperation in the field of taxation; calls for the Commission to be given a greater role in designing the EU strategy against tax havens at a global level;

Obstacles placed in the way of investigators by Swiss bank secrecy laws are removed: banking secrecy may not be invoked as grounds for refusing a request for mutual assistance.
